Police Contract Offers Big Raises, No Significant Accountability Improvements

The most notable thing about the tentative contract between the Seattle Police Officers’ Guild and the city of Seattle is how little it has changed since the most recent contract, signed in 2018; that contract superseded key provisions of a police-accountability ordinance adopted and signed into law in 2017. The proposal, which (as PubliCola reported exclusively on Tuesday) includes retroactive wage increases of 23 percent, includes almost none of the accountability measures from the 2017 ordinance, which was, at the time, considered a baseline for future contracts, not a goal to work toward in a piecemeal fashion in future years.

The Seattle Police Officers Guild posted the contract, which Mayor Bruce Harrell’s labor relations team negotiated with the police union, on Friday morning, then removed the document after PubliCola posted it exclusively on X. The contract, and an accompanying summary, were replaced by images of SPOG President Mike Solan and the message, “Thank you for your support.”

The contract includes some gestures at reform, though it makes none of the major changes demanded by police accountability advocates back in 2018. For example, the contract removes a requirement that the Office of Police Accountability, which investigates police misconduct allegations, notify an officer within five business days that they are under investigation for misconduct. It also clarifies that when an officer takes a discipline decision made by the police chief to an outside arbitrator, the arbitrator is supposed to give “deference” to the chief’s decision.

Some of the changes that were included in the 2017 law, but are still not incorporated into the police contract seven years later, include:

The elimination of arbitration as an option when officers disagree with a disciplinary decision. Arbitration, conducted by randomly chosen attorneys from across the country, often results in a reversal of discipline, undermining both OPA and the police chief.

Giving the Office of Police Accountability subpoena power in investigations and more say in criminal investigations into officer misconduct. Under the tentative contract, OPA will continue to have no authority to conduct investigations into possible criminal activity by officers—the most serious allegations; instead, SPD will continue to conduct criminal investigations into its own officers without oversight from the accountability office.

The “purpose” section of the contract, which outlines the reasons for the contract between the city and the police guild, includes no references to accountability; instead, the section refers to pay and working conditions for officers without any reference to what the public gets in return.

Officers can still present “new” evidence after the OPA has determined that they committed misconduct and recommended appropriate discipline, even if they were aware the evidence existed earlier but did not disclose it.

Firing an officer over misconduct still requires a vaguely defined “elevated standard of review”—as opposed to the lower “preponderance of the evidence” standard— if being fired would be “stigmatizing” and make it hard for a former SPD officer to get a job as a police officer elsewhere.up

The standard for proving that an officer was dishonest—a major violation of SPD policy—includes proving not just that they lied, but that they did so intentionally. The 2017 legislation would have required officers to be truthful in all situations, whether or not OPA or a court can prove that they did so intentionally, including when testifying in court, filling out police reports, and reviewing use of force incidents.

The tentative contract, which runs through the end of 2023, is dated retroactively to January 6, 2021—the day of the national insurrection and attempted takeover of Congress by rioters attempting to overturn the election for Trump. SPD officers made up the largest known contingent of police who attended the January 6 rally; police chief Adrian Diaz later fired two officers who participated directly in the insurrection.

The ordinance still requires requires the OPA director—a civilian—to use sworn investigators to conduct any investigation where the alleged misconduct could result in termination. The accountability ordinance would have given the OPA director the ability to decide who investigates these cases.

The 2017 law also called for an internal office to manage secondary employment because of the potential for conflicts of interest and persistent problems with officers abusing their authority during off-duty work—for example, by using companies they control to fix prices for off-duty work directing traffic at parking garages.

The city and SPOG reached the tentative agreement on Saturday, starting a 30-day countdown for the city to file an update with the federal judge overseeing a consent decree between SPD and the Department of Justice, informing him how the new agreement impacts the city’s accountability system, if at all. The city council has repeatedly identified hiring more police officers as their top priority, even pushing an independent commission to adopt an easier test for police recruits so that fewer potential officers will be disqualified during this initial weeding-out phase.

The federal, James Robart, lifted most of the consent decree last year, but found the city still had work to do on accountability, along with racially biased policing and crowd control. The vice president of SPOG, Daniel Auderer, was recently caught on body-worn video joking with SPOG president Solan about the death of pedestrian Jaahnavi Kandula, who was struck in a crosswalk by a speeding officer in 2023. Meanwhile, as PubliCola reported last month, the department has ignored a 2021 law that restricted their use of certain “less-lethal” weapons for crowd control.

As Questions Swirl About SPD Accountability, City Announces “Dual-Dispatch Pilot” for Low-Priority Calls

On Thursday, during a press conference outlining his proposal to expand, reorganize, and rename the city department that responds to 911 calls, Mayor Bruce Harrell said he believed “the process is working” in the case of Daniel Auderer, a police officer and Seattle Police Officers Guild vice president who was caught on body-worn video mocking the death of 23-year-old student Jaahnavi Kandula with SPOG president Mike Solan. The video, which only captured Auderer’s side of the conversation, was recorded shortly after Officer Kevin Dave struck and killed Kandula on January 23.

Harrell was announcing $6 million in new funds for the Community Assisted Response and Engagement (CARE) department, formerly known as the Community Safety and Communications Center; that money will help hire 13 new staff, including behavioral health specialists, to respond alongside police to low-priority calls.

The question about Auderer came from a trainee at the 911 call center in SPD’s West Precinct where the announcement took place.

“Sometimes justice is not quick, due process sometimes is not quick, certainly not as quick as people would like to see,” Harrell said. “But everyone accused of misconducth as the right to due process and I will defend that process. We can’t be quick to judgment. … I have a member of my administration who was sentenced to prison for over 20 years without the possibility of parole. He was unfairly convicted because of the lack of due process. So I will defend due process … and hopefully we’ll see outcomes that people will say, ‘the system worked’.”

As PubliCola reported last week, an SPD employee saw the disturbing video and reported it to supervisors on August 2. Six days later, Auderer sent a letter to the Office of Police Accountability (OPA) attempting to minimize his and Solan’s comments, saying the two SPOG leaders were laughing at “the ridiculousness of how I have watched these incidents play out as two parties”—in this case, Kandula, who was killed by a speeding police officer just hours earlier, and SPD’s own lawyers—”bargain over a tragedy.”

Earlier this week, the Community Police Commission, a civilian oversight body, wrote a letter calling on Police Chief Adrian Diaz to immediately suspend police officer Daniel Auderer without pay while the investigation is ongoing.

SPOG released Auderer’s August 9 letter to a conservative radio commentator the day before PubliCola and the Times received the video in response to records requests, and posted, on social media on September 15.

Earlier this week, the Community Police Commission, a civilian oversight body, wrote a letter calling on Police Chief Adrian Diaz to immediately suspend Auderer without pay while the investigation is ongoing. The CPC also asked Diaz to “immediately engage in a workgroup consisting of the Seattle Police Accountability Partners and members of the community to address repeated concerns with the culture of policing and police practices at SPD.” The other accountability “partners” are OPA and the Office of Inspector General, an independent office that reviews and audits SPD as well as OPA.

Auderer’s statements, the three CPC co-chairs wrote, “are horrifying and raise serious concerns about his attitude toward and interactions with members of the community, and his ability to investigate cases equitably, accurately, and without bias and keep the City’s residents safe. While the [body-worn video] does not capture SPOG President Mike Solan’s comments on the other end of the call, there is simply no context that could possibly make these comments acceptable.”

As of Friday, CPC co-chair Joel Merkel said SPD had not responded to the letter; a spokesperson for SPD said they had no comment beyond the statement they released on their website shortly after we published the video last week.

The city has been promising to send civilian first responders to calls that don’t require a police response since 2020, when thousands protested police misconduct after the death of George Floyd. In 2021, then-mayor Jenny Durkan announced the launch of a new crisis response team within the fire department to respond to some crisis calls, but the proposal never got off the ground.

Harrell, similarly, has vowed since taking office in 2022 to create a new “third public safety department,” in addition to police and fire, that would include a new type of civilian first responder. This week’s announcement does include new civilian responders. But they won’t be going out to most calls involving people in crisis.

Instead, they’ll be deployed, along with police, to two call types that police have already determined do not necessarily require a police response. Priority 4 calls, the lowest priority, are non-emergency calls that generally don’t require a police response at all. Priority 3 calls are for minor issues that may or may not get a police response, depending on officer availability—everything from noisy neighbors to off-leash dogs to illegal parking.

Priority 3 calls do include “person down” calls, where someone is unconscious in public, and welfare checks—two call types that might benefit from a behavioral health response, Diaz noted. “Sometimes, a highly intoxicated [person] might actually be … experiencing some level of crisis. Not always, but in some cases,” Diaz said.

However, the majority of Priority 3 calls, Diaz said, are so-called “paper calls”—calls where the incident already happened and the only thing left to do is file a report. Harrell characterized the new program as a “dual dispatch pilot” that the city will evaluate in a year or two “to see where it makes sense… [and] where the data leads us.”

SPD, Diaz noted, already has an internal crisis response team; more than 60 percent of officers have also taken a 40-hour course in crisis intervention training.

UW Can Keep Civilians Who Replaced Campus Cops, Choe Show Canceled, Dembowski Bows Out

1. The University of Washington prevailed earlier this month in a labor dispute with the union representing the officers of its campus police department, allowing it to move forward with a plan to the replace armed police officers in its residence halls with new, unarmed “campus safety responders” without going to the bargaining table. The decision by Washington’s Public Employee Relations Commission (PERC) could set the stage for other employers to shift some duties from sworn officers to unarmed civilian responders—a change that some in Seattle’s government see as a possible fix for the city’s shortage of sworn police officers.

After pressure mounted on the school’s administration in the summer of 2020 to reevaluate the role of armed police officers in campus security, UW president Ana Mari Cauce promised to expand the university’s existing civilian responder programs by adding a new team who could respond to non-criminal emergency calls, including welfare checks. Less than a year later, the university also opted to remove armed police patrols from its dorms, replacing them with a combination of in-house social workers and campus safety responders.

The rank-and-file police officers who previously patrolled the dorms objected to the new arrangement, filing an unfair labor practice complaint accusing the university of “skimming” some of their responsibilities to a new team of employees in violation of the university’s contract with their union.

PERC sided with the university, ruling that the decision to use civilians instead of sworn officers to patrol the dorms has a “limited impact” on the police officers themselves—an impact, they wrote, that is outweighed by UW’s “compelling interest” in rethinking how it approaches campus safety. According to the ruling, the change did not require UW to lay off or cut the pay of any police officers, nor did it reduce opportunities for the officers to work overtime. The PERC ruling also noted that UW has only hired four campus safety responders since January, resulting in hardly any change to who responds to emergency calls on campus. Between September of 2021 and the start of this month, sworn UW police officers received 205 dispatches to residence halls; the campus safety responders received only six.

The ruling could be significant in Seattle, where city council members and members of Mayor Bruce Harrell’s staff have expressed interest in shifting some responsibilities from sworn police officers to civilian units like the Community Service Officers (CSOs) and parking enforcement officers. Although the Seattle Police Officers’ Guild (SPOG) has generally opposed reducing officers’ responsibilities, SPD’s ongoing staffing shortage has increased pressure on elected officials to find ways to allow SPD officers to focus on serious crimes by assigning more responsibilities to civilians.

2. King County Councilmember Rod Dembowski quietly bowed out of the race to replace King County Prosecuting Attorney Dan Satterberg less than two months after he filed for candidacy in early January. Dembowski told PubliCola that he filed to “take a look at the race,” but he did not elaborate about his decision to drop out. The remaining candidates include the King County Prosecutor’s Office’s current chief of staff, Leesa Manion, as well as former deputy prosecuting attorney Stephan Thomas and current Federal Way Mayor Jim Ferrell.

3.KOMO TV, which is owned by the national conservative broadcasting conglomerate Sinclair Broadcast Group, fired reporter Jonathan Choe today after Choe posted flattering coverage of a rally by the Proud Boys, a white nationalist group, to protest the continued detention of those implicated in the January 6 attack on the US capitol.

Choe promoted the rally in a series of tweets that included a montage of protest footage set over a white nationalist anthem known as the “Männerbund,” which includes the lyrics, “In our own towns we’re foreigners now, our names are spat and cursed/ The headline smack of another attack, not the last and not the worst.” That tweet, which Choe later deleted, encouraged readers and KOMO viewers to come down and meet with the Proud Boys, who would stay on hand to “mingle and answer questions if anyone is interested in learning more about their cause and mission.”

In a second tweet, Choe praised the Proud Boys for being polite and allowing him to “record freely on public property without interference. No umbrellas or hands in my face.” The latter was a reference to Choe’s frequent claims that he is targeted by protesters or “antifa”. On his feed, Choe frequently tags Andy Ngo, a Twitter provocateur who has written sympathetically about the Proud Boys and has worked tirelessly to demonize “antifa” (which he characterizes, inaccurately, as an organized, violent group of militants) to his right-wing audience.

PubliCola independently confirmed Choe’s firing. David Neiwert, reporting for DailyKos, received a statement from KOMO saying the station “did not direct or approve Jonathan Choe’s decision to cover this weekend’s rally, nor did his work meet our editorial standards.”

Choe is best known in Seattle for his efforts to confront and elicit reactions from unsheltered people and their advocates, including mutual aid volunteers. His Twitter feed is an avalanche of footage showing people in crisis and commentary condemning homeless people for existing in public, including endless poverty porn-style videos of people living unsheltered.

Although KOMO has an official policy of “objectivity,” Choe’s feed overflows with over-the-top praise for city workers conducting sweeps of homeless encampments. (“GAME OVER,” he tweeted repeatedly during a recent sweep of tents across the street from City Hall). On many occasions, Choe has started on-camera confrontations with volunteers and activists working with unsheltered people, even identifying some to his readers (and tagging Ngo) as “antifa.” (Choe has blocked us on Twitter, along with many other local reporters following this story.)

Sinclair, which produced the infamous “Seattle Is Dying” series, expressed no public concerns that Choe’s coverage of homelessness was exploitative and misleading, nor that it put homeless people in danger and violated their right to privacy. For KOMO, advocating for white supremacy appears to have been a bridge too far; posting videos condemning homeless people for existing in public, apparently, was not.

County Invests in Hotel-Based Shelter, SPOG Campaigns for Sawant Recall, Durkan Records Requests Raise Disclosure Questions

1. In his State of the County address Tuesday, King County Executive Dow Constantine announced that the county would purchase the Inn at Queen Anne, which has been serving as a temporary shelter operated by Catholic Community Services since April of last year.

The 80-room hotel, which CCS will continue to operate, will cost the county $16.5 million; the money will come from the new “health through housing” sales tax that the county council passed—with some notable abstentions from suburban cities—late last year. The county plans to purchase “several more properties in several more cities … in the coming weeks,” Constantine said in his address.

Even as the county moves to buy hotels, the city of Seattle is pushing in the opposite direction.

In an interview yesterday, Constantine said he saw the hotels as “stops on the way to permanent supportive housing or independent housing, including affordable housing—places where you could live for a while and stabilize and take advantage of services.” Traditional, congregate shelters, including “enhanced shelters” like Seattle’s Navigation Center, don’t offer the kind of privacy and stability hotel rooms provide; “the difference between being able to come inside for the night and having a place of your own with a lock on the door seems to be everything,” Constantine said.

Even as the county moves to buy hotels, the city of Seattle is pushing in the opposite direction. Between now and June, Seattle plans to close down a temporary shelter at Exhibition Hall and relocate the people living there into shelters whose populations were “redistributed” last year, including the Navigation Center. After resisting calls to move Seattle’s homeless population into hotel-based shelters, the city finally rented about 200 hotel rooms this spring—a temporary solution (the rooms will be occupied for 10 months) and one that represents a fraction of the need. At the same time, Seattle is ramping up homeless encampment sweeps.

Asked about the apparent contrast between the county’s approach and Seattle’s, Constantine said, “first off, we can’t let the perfect be the enemy of the good. If people need a place to be inside at night, we have to figure out a way to make that happen.” However, he added, “If you’re going to move people out of an encampment, at a bare minimum, you can’t just chase people from one street corner to another or one park to another. That is tremendously unhelpful.”

Constantine is up for reelection this year; his challenger, state Sen. Joe Nguyen, told PubliCola he supports the regional homelessness authority that the county is setting up but thinks the county has failed forge partnerships with the leaders of cities within the county.

2. The Seattle Police Officers’ Guild (SPOG) asked its members to participate in signature-gathering events for the Recall Sawant campaign over the weekend, according to an email from SPOG leadership.

The email, which the police union sent to its members last Friday, asked off-duty officers to appear in plain clothes to collect signatures and wave anti-Sawant signs at four Capitol Hill intersections on Saturday and Sunday.

Recall Sawant campaign manager Henry Bridger II told SPOG members in the email that their presence would help “beef up” an otherwise meager group of volunteers. “Our goal is to have about 40+ people each day and we have about 15 right now and many probably won’t show for fear of retaliation,” he wrote, warning that “Sawant’s people will be there in mass [sic] to interfere.”

“We are just wanting to have plain-clothed volunteers to help hold signs and gather signatures so we look like we have a lot of coverage,” Bridger added. He also asked officers to bring their family and friends to boost turnout.

SPOG’s push for turnout seems to have fizzled: Twitter chatter about campaign volunteers at the intersection of Broadway and Denny suggests that few recall supporters showed up at the campaign event.

3. On Monday, the Seattle Ethics and Elections Commission held a brief discussion on a report that prompted outrage from major-media outlets last week because it revealed that Mayor Jenny Durkan’s office had failed to produce many of her text message in response to records requests in 2020.

Specifically, the report—produced by independent public disclosure expert Ramsey Ramerman in response to a whistleblower complaint by two longtime mayoral public disclosure officers—found that 10 months of Durkan’s texts were missing, and that the mayor’s office had routinely excluded Durkan’s texts from requests for text messages from mayoral staff, on the grounds that the requests didn’t explicitly include the mayor.

The report, posted on the city’s website last week, was a bombshell, but it seemed to hit major media outlets somewhat differently than it hit us at PubliCola, for a simple reason: While we have filed dozens of records requests for text messages and other forms of communication, such as messages on internal City messaging systems, during the Durkan administration, we have routinely received only emails in response—a fact that suggests Durkan and her entire staff don’t use text messages, internal communications systems, or any other form of written communication other than email at all.

Since we know this is not the case (in fact, a quick text history search found a number of messages that would have been responsive to some of our requests), the only conclusion we can reach is that the mayor’s office did not provide records that would have been responsive to our requests, despite having the ability to do so and despite apparently filling other media outlets’ requests for text messages and other forms of communication. Fizz: Hotel Shelter Debate Continues, City Labor Negotiator Resigns, Poll Tests Mayoral Messages

1. City council member Andrew Lewis, who chairs the council’s homelessness committee, told PubliCola Monday that he’s working on legislation that would authorize funding for new non-congregate shelters, such as hotels, that could be reimbursed by FEMA—which, as we’ve reported, is now paying for all reimbursable expenses, including most shelter services, at 100 percent.

The legislation, which Lewis said won’t be baked until late this week at the earliest, would respond to some of the objections Mayor Jenny Durkan’s office has raised about seeking FEMA reimbursement, which include “onerous” paperwork requirements, a competitive procurement process, and pre-approval from the federal agency.

In addition to those issues, Durkan’s office has said that FEMA will not pay for shelter services of any kind, a claim that is not borne out through the experience of cities like San Francisco, which has received full reimbursement for about 85 percent of the cost of hotel-based shelters and recently announced it was opening 500 new hotel-based shelter rooms using FEMA money.

“We are in a crisis that is exacerbated because of COVID,” Lewis said. “It is totally legitimate for us to seek FEMA reimbursement.”

Lewis noted that the issue of FEMA reimbursement has been somewhat conflated with funding for JustCARE, a hotel-based shelter program for high-needs individuals with a high impact on the neighborhoods where they live. Among other issues, the mayor’s office has said that JustCARE wouldn’t qualify for FEMA funding because reimbursement requires a competitive contracting process.

“The goal with this legislation is going to be to take a step back and assume that we’re making something new from whole cloth that is defined around the fact of what we need to do for FEMA reimbursement,” Lewis said. “If hotel rooms are a problem for some actors in city government, there are other types of non-congregate shelter we can seek FEMA reimbursement for.”

Durkan has strongly resisted proposals to shelter unhoused people in hotels since the beginning of the pandemic, long before the current FEMA reimbursement debate. Last year, for example, her office consistently responded to questions about why the city wasn’t opening hotel-based shelters by deflecting, noting that the city did contribute funding to the Downtown Emergency Service Center’s hotel-based shelter in Renton.

The mayor has been more open to funding tiny house villages—encampments made up of small wooden structures about the size of garden sheds— during the pandemic, and Lewis has separately proposed opening eight new villages around the city. Unsheltered people consistently prefer a tiny house to a conventional shelter bed, but hotels offer a number of stabilizing amenities that tiny houses do not, including television, private kitchenettes, beds, and a private place to bathe and relax. Hotel-based shelters also provide revenue for an industry that has been hard hit by the pandemic.

As for JustCARE: County funding for the program is scheduled to run out on March 15, but the county is reportedly working on another stopgap solution to keep the program running in the absence of any city support. Durkan’s office considers JustCARE, which is run by Seattle-based service providers and focused on encampments in Seattle’s Pioneer Square, “a county program.”

2. Jana Sangy, the city’s director of labor relations, announced last week that she’s leaving her position in early June.

Although Sangy’s announcement didn’t include much information about why she’s leaving, staff from Mayor Jenny Durkan’s office had reportedly intervened at a micro, line-item level in individual city contracts in a way that previous mayors have not—which could certainly make the job of a labor relations director more challenging. Labor Relations, which is part of the city’s Department of Human Resources (SDHR), ultimately answers to the mayor and represents the executive’s perspective in labor negotiations.

Sangy’s resignation comes as the city prepares for contract negotiations with the Seattle Police Officers’ Guild (SPOG), the city’s largest police union and one of the key challenges for the labor relations unit.

“There is not a very deep well of stability to fall back on during this transition to yet another interim director. It begs the question why this mayor has had such difficulty retaining solid talent in such a critical role.”

SPOG’s last city contract expired at the beginning of 2021, but the bargaining process won’t begin until the Labor Relations Policy Committee—a group made up of five council members, SDHR Director Bobby Humes, and City Budget Office Director Ben Noble—finishes deliberating on the city’s negotiating priorities and strategy. complete their deliberations. During preparations for bargaining with police unions, representatives from Community Police Commission, Office of Police Accountability and Office of the Inspector General join the LRPC. Once bargaining begins in earnest, a negotiator from the Labor Relations unit will serve as the city’s labor law expert at the bargaining table.

Sangy started in June 2019, becoming the third person to fill that role since 2017; her immediate predecessor, Laurie Brown, was an interim director appointed by Durkan in December of the previous year. According to an email from Humes to city employees last week, Sangy’s interim replacement will beJ eff Clark, who currently serves as one of the unit’s negotiators. Lisa Low, a spokesperson for the city’s HR department, told PubliCola that department leaders “do not anticipate any impacts to the timeline for SPOG bargaining.”

But Peter Nguyen, who represented the Labor Relations unit during the last round of bargaining with SPOG in 2018, thinks that Sangy’s departure ahead of one of her unit’s most crucial performances is a sign of a struggling unit. “The resignation of the city’s Labor Relations Director is troubling,” said Nguyen. “There is not a very deep well of stability to fall back on during this transition to yet another interim director. It begs the question why this mayor has had such difficulty retaining solid talent in such a critical role.”

Sangy did not immediately respond to a request for comment Monday.

Seattle residents received two more polls centering on mayoral candidate (and city council president) Lorena González over the last week, both testing positive and negative messages about González, her current and likely opponents, and groups like “the Chamber of Commerce” and “the Black Lives Matter movement.” One poll was an online survey, the other a live poll, but the similarities between them suggest they are versions of the same poll put out by the same campaign or group.

The specific messages the polls were testing were less interesting than what they suggest, cumulatively, about the upcoming election, which will pit González and Chief Seattle Club director Colleen Echohawk—the two current frontrunners—against a long list of other candidates that could include former city council member Bruce Harrell, current deputy mayor Casey Sixkiller, and former state legislator and 2017 mayoral candidate Jessyn Farrell. Federal Judge: Seattle’s Path to Compliance With Consent Decree Still Unclear

U.S. District Court Judge James Robart convened a hearing on Thursday afternoon to review the city of Seattle’s progress toward implementing police reform and address how Seattle’s path to compliance with the federal consent decree has changed in the wake of last summer’s racial justice protests.

During Thursday’s hearing, the first since the protests, Robart emphasized that the city is still out of compliance with the consent decree in the areas of discipline and accountability, and that Seattle’s path toward an end to federal oversight is still unclear. Robart added that the federal court is now reviewing another possible breach of the consent decree: specifically, whether SPD’s response to last year’s protests leaves the city out of step with the court’s standards for appropriate use of force.

The consent decree—the agreement between the city and the Department of Justice that empowers the federal court to oversee reforms to the Seattle Police Department—dates back to 2012, when the DOJ investigation found that SPD officers frequently used excessive force without consequences. To end federal oversight, the city first needs to achieve “compliance” with the terms of the consent decree and remain in compliance for two years; Robart uses input from the city, accountability experts, and a court-appointed monitoring team to decide what compliance entails.

The court-appointed monitoring team, led by Dr. Antonio Oftelie since last September, submitted a work plan Thursday morning to track the implementation of reforms to SPD and the efficacy of the city’s accountability structure in 2021. As SPD prepares to rework its use-of-force and crowd management policies, and while the OPA and OIG conduct follow-up investigations into protest-related police misconduct and systemic policy problems, the monitoring team will act as an auditor, said Monisha Harrell, the court’s deputy monitor. “Our ultimate goal is to not exist,” she told PubliCola. “If the system is working well, then we aren’t needed. So we look for cracks in the system.”

The city has nominally met Robart’s standards before: In 2018, the judge ruled that Seattle was in “full and effective” compliance with the terms of the consent decree. But less than a year later, Mayor Jenny Durkan and the city council approved a contract with the Seattle Police Officers Guild (SPOG)—the largest police union in the city—that undercut an array of reforms to SPD  accountability. After outcry from accountability advocates, Robart decided that Seattle no longer met the court’s expectations for police accountability and discipline, leaving the city partially out of compliance with the consent decree.

In his ruling, Robart directed the City Attorney’s Office (CAO) to submit plans to restore the accountability reforms by July 2019. More than a year later, the city not submitted a plan. Nevertheless, in early May of 2020, City Attorney Pete Holmes filed a motion to cut back the court’s oversight of SPD, contending that SPD had “transformed itself” under the federal court’s oversight. But Robart never ruled on the city’s motion to end some portions of the consent decree, because the city withdrew the motion shortly after the killing of George Floyd by Minneapolis police officers on May 25 sparked citywide protests.

City Attorney Pete Holmes, who represented the city during Thursday’s hearing, told the court that the protests were a “stress test” for SPD’s accountability structure. However, Holmes pointed to a letter published by Interim SPD Chief Adrian Diaz on Wednesday—entitled “Surpassing Reform: SPD’s Commitment to Accountability and Transparency”—as evidence of the “spirited tenacity of SPD to provide safety and constitutional policing even in the midst of the pandemic.” Holmes also expressed his belief that the accountability agencies—the Office of Police Accountability (OPA), Office of the Inspector General (OIG), and the Community Police Commission (CPC)—are “living up to the test” presented by SPD’s protest response.
