More Details Emerge About Black Brilliance Project’s Research Plan

PubliCola has obtained a copy of King County Equity Now’s (KCEN) work plan for the public safety research project that’s intended to lay the groundwork for a participatory budgeting process next year. About $30 million of the $1.5 billion general fund budget is supposed to be allocated using participatory budgeting—a process that enables the public to vote on which projects and priorities they want to fund—next year.

The Seattle City Council finalized a $3 million contract with Freedom Project Washington, a nonprofit that offers programs inside and outside prisons to help with reentry and prevent re-incarceration, to fiscally sponsor KCEN’s research last week. With the contract finalized and the work plan submitted, Freedom Project Washington now has access to the first $250,000 of that total. Freedom Project Washington is allowed to subcontract with other groups to conduct parallel research. Currently, though, KCEN is the group’s only subcontractor.

The work plan offers the most detailed glimpse yet into the workings of the Black Brilliance Research Project, which KCEN launched in mid-September. KCEN has hired more than 100 paid researchers—largely Black—who will work until at least next spring and present findings from their research to the council twice: once in December and again in the first quarter of 2021.

The work plan includes a step-by-step guide for the new researchers, for whom KCEN hopes the experience will be an “opportunity for personal and community growth.” The instructions give the researchers significant leeway in devising their own research areas, questions and methods.

Broadly, the researchers are responsible for studying the “community safety” and “community health” priorities of specific demographic groups; the work plan names “Afro-Latinx people who use wheelchairs” or “second-generation Somali youth” as examples of possible focus areas. The work plan also outlines possible methods for answering research questions: for instance, to study the effectiveness of community response teams as an alternative to 911 responders, the work plan suggests that researchers could measure changes in 911 use after the establishment of a community response team.

In September, KCEN launched an online survey, available in 15 languages, to determine what kind of barriers exist for potential research participants. Since September, 850 people have taken the survey: over half of the respondents have been Black, and a similar proportion have been younger than 34.  According to the survey’s findings, more than half of potential participants would need help paying for gas to attend research sessions, roughly half requested help paying for groceries, and more than a third requested access to high-speed internet, laptops or tablets.

Both the survey and the group’s tentative budget reflect an assumption that much of the research would take place at in-person community meetings and focus groups. According to the “Blueprint for Divestment/Community Reinvestment” released by KCEN and Decriminalize Seattle last summer, the group intended to spend more than $200,000 on transportation and childcare to help research participants attend in-person meetings (though those dollars could also be used to provide childcare for participants taking online surveys).

In a conversation with PubliCola, a KCEN spokesperson noted that they intend to spend a sizeable portion of the contract dollars to improve internet and computer access for potential research participants, which would become essential if the Black Brilliance Research Project shifts to an online-only model.

The work plan does not include a clear explanation of how the research findings will inform the structure of next year’s participatory budgeting process, but it does include a list of preliminary recommendations for changes to the city’s budget priorities, based on feedback from respondents to the project’s surveys and from interviews with Black residents. These priorities include reducing the size of the Seattle Police Department, more investment in community-based alternatives to policing, and less spending on “government responses to harm,” such as social workers employed by the city.

Morning Fizz: Participatory Budgeting Project Moves Forward, Deputy Mayor Moves Out

1. On Tuesday morning, the Seattle City Council’s legislative department provided a copy of their newly finalized $3 million contract with Freedom Project Washington to PubliCola. The Freedom Project will oversee King County Equity Now’s Black Brilliance research project, which is working on a plan to allocate about $30 million in city funding through a participatory budgeting process next year. Freedom Project Washington is expected to subcontract with other nonprofits to run parallel research projects, but the city has yet to publish the names of the other subcontractors.

The contract has been months in the making. KCEN began laying the groundwork for a Black-led research project to determine the city’s public safety priorities before the council funded the work through its midyear 2020 budget balancing package passed in August. The group launched the Black Brilliance Research Project in September, spending their own reserves while waiting for the arrival of city dollars; since then, KCEN has fielded nine research teams to conduct interviews, surveys, and community meetings. KCEN has not responded to questions for more details about the community meetings and interviews.

Freedom Project Washington has close ties to KCEN—its executive director, David Heppard, has been a regular speaker at the group’s online press conferences—but it was not the city’s first choice of contractor. The council and KCEN originally planned to contract with the Marguerite Casey Foundation but decided to go with the Freedom Project because the Freedom Project, which has been a fiscal sponsor of other nonprofits in the past and has previously received city contracts, could get up and running more quickly. Freedom Project Washington will process payments and expenses on KCEN’s behalf; in return, KCEN will manage the “day-to-day operations” of the Black Brilliance Research Project.

The budget also designated roughly $300,000 to “COVID-related support,” including face masks and “internet connectivity support” for research participants, as well as nearly $400,000 for accessibility resources (childcare at community meetings, transportation, translation) and $500,000 for “cash assistance and direct support for community members.”

The only window into how KCEN plans to spend $3 million on community research is their “Blueprint for Divestment/Community Reinvestment,” a document released last summer that includes KCEN’s own recommendations for city policy and budget priorities and a tentative budget for the Black Brilliance Research Project. As PubliCola reported in August, that budget allocated only around $1 million to pay research staff, though senior KCEN researcher LéTania Severe later said that the group intends to hire as many as 133 staffers over the coming year.

The budget also designated roughly $300,000 to “COVID-related support,” including face masks and “internet connectivity support” for research participants, as well as nearly $400,000 for accessibility resources (childcare at community meetings, transportation, translation) and $500,000 for “cash assistance and direct support for community members.”

KCEN has not clarified how those resources would be allocated, nor whether and how their budget has changed to reflect tightening restrictions on in-person gatherings like community meetings. The contract with Freedom Project Washington does not include any directives about how to spend the contract dollars, so the project’s budget items will be decided by Freedom Project Washington and KCEN.

According to the contract, KCEN is expected to present their work plan and a preliminary report on their community research projects, including digital documentation of “community research that was presented as visual/performing arts, spoken word, etc.,” to the council in November, though the group’s opportunities to present at a council briefing before the end of the month are dwindling.

A final report on their “findings and recommendations for [a] participatory budgeting framework and mechanisms” informed by “community dialogues” is due in the first quarter of next year.

Council Staff: Mayor’s Proposals Could Promote “Racism Cloaked in the Language of Anti-Racism and Equity”

Foreshadowing what will likely be a heated debate over Mayor Jenny Durkan’s plan to wall off $100 million in the city budget for future “investments in BIPOC communities” that will be decided by an Equitable Investment Task Force appointed by the mayor, Seattle City Council central staff released an unusually blunt memo last week cataloguing potential issues with the mayor’s plan.

The memo raises two high-level issues with Durkan’s proposal. First, according to the staffers, it duplicates work that the city has already done, perpetuating the city’s practice of asking members of marginalized communities to provide recommendations again and again without ever taking action on those recommendations.

“These different and potentially overlapping processes and funds raise concerns that the Council has expressed in previous years regarding a lack of alignment of efforts around the criminal legal system and insufficient application of racial equity analyses, as well as the challenges of successfully doing anti-racism work in a racist institution,” the memo says.

Just this year, for example, the mayor has proposed: A new Community Safety Work Group to “integrate community input into policy changes and operationalize community priorities to reshape community safety and policing in Seattle”; a “functional analysis interdepartmental team” (IDT) that would offer advice on “reimagining community safety”; a Joint Community Safety IDT to “advise upon and implement policies to reinvent policing and re-imagine community safety in the City of Seattle by centering the experiences of BIPOC communities”; a Functional IDT to decide how to transfer some functions of SPD, such as 911 dispatch, out of the police department; and the Equitable Investment Task Force, which is supposed to decide how to spend $100 million on “BIPOC communities.”

Those new efforts come on top of ongoing initiatives such as King County Equity Now’s Black Brilliance Project; plans for participatory budgeting in 2021; and $1.1 million the council previously allocated to groups working to create alternatives to the criminal justice system, such as Community Passageways and Creative Justice. Durkan’s 2021 budget would eliminate this funding.

Durkan’s communications director, Kamaria Hightower, said the processes the mayor has proposed are necessary counterweights to the council’s impulse to rush forward and cut the police department without a plan. For example, she said, the interdepartmental teams are necessary to figure out how to restructure the police force in an orderly way. “[T]he Council committed to 50 percent reductions [to SPD] without outlining a comprehensive plan or timeline for steps to reimagine policing and building the right community safety alternatives,” Hightower said.

As Public Demands for Police Cuts Continue, Parking Enforcement Officers Could Take On Greater Role

During a public safety budget hearing last Thursday, Seattle City Council public safety committee chair Lisa Herbold suggested a wider role for an agency that’s received relatively little attention during the recent debates about reducing the size and role of the Seattle Police Department: SPD’s Parking Enforcement Unit.

The idea of expanding the role of parking officers to include duties currently performed by armed police comes as the city council deliberates on Mayor Jenny Durkan’s proposed 2021 budget, which includes only minor cuts to SPD’s budget. At a public hearing Tuesday night, dozens of residents asked the council to amend Durkan’s proposal to defund SPD by at least 50 percent, in line with what protesters and advocates have been demanding for months.  

After raising the issue of overtime spending for SPD staffing at special events, Herbold said she was “grateful to [parking enforcement officers] for signaling their willingness to take on that work.” She pointed to a letter written by the Seattle Parking Enforcement Officers’ Guild to council members expressing interest in expanding their duties to include not only a greater role at special events, but also an array of other roles currently filled by more highly paid sworn SPD officers. As Herbold noted, SPEOG also said that they would prefer to move into the proposed new Department of Public Safety, rather than the Seattle Department of Transportation (SDOT), as Durkan has proposed.

The concept of the Department of Public Safety originates in a resolution the council passed in August recommending the creation of a “civilian-led Department of Community Safety & Violence Prevention to remove certain functions from the Seattle Police Department.” However, the absence of any concrete foundations for the department has become a sticking point in the ongoing budget discussions. The budget Durkan transmitted last week limited budget cuts to SPD on the grounds that the city has not yet developed alternatives to police, while the council contended that developing those alternatives will require shifting money from SPD’s budget.

In the letter to council, the parking officers offered to take over array of “services that were formerly provided by sworn SPD officers” ranging from managing red light violations to responding to car prowls, minor accidents, illegally parked RVs and abandoned vehicles. Currently, those types of incidents make up roughly 20 percent of the calls for service to which SPD responds; traffic incidents alone account for nearly 15 percent of all calls. While parking enforcement officers can’t replace SPD at to every traffic- or car-related incident, the guild argues that they can take on a sizable portion of SPD’s workload, which would in turn significantly reduce interactions between civilians and armed police officers.

Union president Nanette Toyoshima, who wrote the letter to council, said Durkan’s proposal to move parking enforcement into SDOT caught her unit off-guard. “We only learned of this potential move through Twitter and a press conference,” Toyoshima said, referring to Mayor Durkan’s July 13 announcement that she intends to move a variety of civilian units out of SPD, including parking enforcement and the 911 call center. “It was a bit of a rude awakening after over 50 years with SPD.”

She said the guild had no complaints about being housed in SPD, but that they were also responsive to the public push to civilianize some roles held by police. “No matter where we’re moved—to a new [public safety] department, to SDOT, or if we stay in SPD —we’re interested in being part of the solution,” she said. “Out-of-Order” Layoffs at Center of Police Defunding Debate

For the past several weeks, Mayor Jenny Durkan and Seattle Police Chief Carmen Best have argued that the City Council’s plan to reduce SPD’s budget through targeted layoffs would be infeasible and potentially illegal. Council members say that isn’t true, and argue that the mayor and police chief are digging in their heels because they don’t want to do any layoffs at all.

The council’s proposal would use a series of provisos (legally binding restrictions on spending) to eliminate 70 sworn staff, although the council assumes some of this reduction would be through higher-than-normal attrition. The cuts would come both from specific areas—such the elimination of the Navigation Team—and SPD’s general budget. Council members have suggested that the police department prioritize officers with multiple sustained misconduct complaints when making discretionary layoffs.

The mayor and police chief have said labor rules require SPD to lay off its newest hires first. Those rules are the purview of the Public Safety Civil Service Commission (PSCSC): a three-member quasi-judicial body with one member appointed by the council, another by the mayor, and a third elected by the city’s civil service employees.

Implementing the PSCSC rules as written would require laying off the youngest, most diverse group of recruits in SPD’s history—a group, Durkan said during a press conference Wednesday, who “joined the force knowing that [SPD was] under federal oversight” and are therefore “committed to reform.”  Conversely, doing layoffs out of order would require eliminating the jobs of more white men—a move that Durkan and Best argue could constitute racial discrimination against white officers.

“You can’t make layoffs based on race,” Chief Best said during a press conference Thursday. “I think the [council’s] request would be to skip over some folks in order to retain people based on race and I don’t think that’s allowable.”

Best isn’t alone in this concern. In a council discussion of the proposal late last month, council member Debora Juarez said out-of-order layoffs could constitute “discrimination based on age and sex” and a violation of the 14th amendment. “The means doesn’t always justify the ends if it’s illegal,” Juarez said.

Council member Lisa Herbold, who chairs the council’s public safety committee, and the other council members who support the proposed cuts, are counting on a rarely (if ever)-used clause in the PSCSC’s rules that allows the police chief to request the permission of the PSCSC director for out-of-order layoffs if they would serve the “efficient operation” of the department.

The problem, according to a letter that Office of Labor Relations director Bobby Humes sent to Durkan’s office on Tuesday, is that “[t]his rule has never before been cited or tested, and there is no definition of what the ‘efficient’ operation of the department looks like.”

However, it’s unclear that it’s true that the rule hasn’t been tested; on Wednesday, for example, Durkan said the rule has “historically been used” for individual layoffs. And Durkan’s assertion that Best would “have to justify every single” request for an out-of-order layoff is somewhat at odds with Humes’ memo, which only mentions a possibility that Best may have to justify each individual layoff.

A memo explaining the mayor’s position on out-of-order layoffs distributed to members of the media this week does not list legal precedents to back her statement that out-of-order layoffs would need to be argued individually.

In a press conference with council president Lorena Gonzalez and council member Tammy Morales on Thursday, Herbold responded to some of the mayor and police chief’s claims, starting with Durkan’s claims that out-of-order layoffs are impossible. “The rule exists, and thus it can be used,” said Herbold. “The executive and council should work together to figure out how to use it to meet our shared objectives, and we should not start with the supposition that a rule that exists to be used can’t be used.”

Herbold added that she and her colleagues hope to collaborate with Best to craft the requests for out-of-order layoffs to be sent to PSCSC Director Laura Scheele. The question now, according to Herbold, “is whether [Best] will work with us in developing a request… that has the best chance to preserve the diversity of the police department in a way that is constitutional, legal according to labor law, does not choose layoffs by race, and preserves the efficient functioning of the department as the rule itself requires.”

Best has not yet said whether she would be willing to bring a request for out-of-order layoffs to the PSCSC. At Thursday’s press conference, she said that the council had not asked her to sit down with them (although the council has talked to other members of SPD’s command staff), and said “it definitely feels very personal to me.”

Herbold and her colleagues are still working with the city’s law department to review their options for arguing that out-of-order layoffs serve the “efficient operation” of SPD. She says one of the council’s proposed strategies– targeting officers with extensive records of complaints – would be based on the argument that the time and resources spent processing complaints, disciplinary actions, and appeals undermine the department’s efficiency. However, Herbold acknowledged that the council will have to grapple with the possibility that their strategy will be challenged on the grounds that it involves punishing officers twice for the same offense, which could be illegal.

At the front of Herbold’s mind, however, is convincing Best to bring requests for out-of-order layoffs to PSCSC Director Laura Scheele. “She’s the one who has to make the argument,” says Herbold. “She runs the department, so she’s best placed to make the argument.”

Seattle Mayor’s Proposal To Move Police Investigations Out of SPD Could Have Unintended Consequences

As calls to defund the Seattle Police Department continue, Mayor Jenny Durkan has proposed moving about $56 million out of the Seattle Police Department’s budget into other parts of the city budget—a ledger swap that could actually cost the city more money than the current system and could, advocates say, actually weaken the accountability system.

When announcing the transfers, Durkan’s office described the changes as “actions to transform the Seattle Police Department and reimagine community safety” by responding to requests from community stakeholders. However, it’s unclear where the impetus for the specific changes the mayor proposed—moving 911 dispatch, the Office of Police Accountability, and the Office of Emergency Management out of SPD—came from.

OPA is the city agency that conducts police misconduct investigations. Under the mayor’s proposal, it would move out of SPD and become its own department, most likely reporting “directly to the Executive and Council,” a spokeswoman for Durkan, Kelsey Nyland, says. “Our hope is that by making them a separate office from SPD, there will be an increase in community confidence in their independence from SPD.”

When asked where the mayor got the idea to move OPA of SPD, specifically, Nyland pointed to the “Blueprint for Divestment” produced by King County Equity Now and Decriminalize Seattle, which includes these three items at the end of a long list that includes a hiring freeze, the elimination of the Navigation Team, the elimination of community outreach implicit bias training, and communications, and the elimination of overtime pay.

The agencies that deal with police accountability, including the Community Police Commission—an independent oversight body—and the OPA itself, were apparently not consulted about the change or asked whether they had concerns. (The CPC only received notice about the changes the mayor was proposing a few minutes before her public announcement). But three years ago, when police accountability advocates like the CPC, the ACLU, and the Public Defender Association were crafting a sweeping police accountability bill, they explicitly kept OPA under SPD’s aegis because doing so allowed them direct access to unredacted SPD files and to SPD personnel.

Retired judge Anne Levinson, the former OPA auditor whose recommendations for improvements to the accountability system were endorsed by the CPC in 2014 and incorporated into the 2017 accountability legislation, says the point of that ordinance was to create a firewall between the accountability agencies and SPD while preserving their direct access to data and records, case management systems, 911 calls, and other records.

“The usual progressive position is that in order to accomplish that, they also need to be totally outside of the department,” Levinson says—”not under the department’s organizational umbrella. But when we looked at others across the country, we frequently saw not only were they not well-resourced, but they did not have full, , immediate, and unfettered access to all the information they needed to do thorough investigations. Some have to issue subpoenas or public records requests just to get basic evidence. So we said that until the City can ensure no loss in full, direct, and unfettered access to systems and evidence, OPA should not be moved to a stand-alone City agency. It makes a very significant difference.”

Nyland says that maintaining “unfettered access to SPD data and case files” is the “north star” for Durkan, one that could potentially be achieved by by creating a new “data-sharing system between SPD and OPA” and amending the accountability ordinance.

Public Defender Association director Lisa Daugaard, who served on the CPC and worked on the 2017 law, says that “similar civilian-led oversight bodies in other cities have had extreme difficulty getting access” to records in a timely fashion and have had to resort to subpoenas. “Subpoena power still leaves the agency at arm’s length and taking a shot in the dark about what to ask for,” she says. “It’s extremely helpful that OPA can access the records and data it needs from within the organizational structure.”

OPA director Andrew Myerberg, who at the city attorney’s office in 2017 and worked on the bill, recalls that “the decision was made unanimously [in 2017] to keep OPA in SPD” in order “to preserve access to data and people.”

Myerberg says that not only would the changes likely be subject to collective bargaining (something Durkan acknowledged in her announcement), they would also require approval under a federal consent decree and amendments to the 2017 ordinance. For example, although moving OPA out of SPD could increase community confidence in its independence, Myerberg says, the legitimacy of OPA decisions might be called into question if no one from SPD is in the room when OPA is reviewing investigations. Does the City Council Want to “Fire Half the Police Department Overnight”? Fact-Checking the Mayor and Police Chief’s Claims

After announcing proposals to shift 911 dispatch, the Office of Emergency Management, parking enforcement, and the Office of Police Accountability away from the Seattle Police Department Monday morning, Mayor Jenny Durkan delivered a fiery broadside against the city council, accusing them of proposing an ill-considered plan to slash police spending without giving any consideration to what comes next. Durkan, up for reelection next year, was in full campaign-speech mode, positioning herself as the lone adult among squalling children.

“Seven out of nine council members committed to cutting the Seattle Police Department’s budget by 50 percent without a plan,” Durkan said. “This is simply not responsible. You can’t govern by Twitter or bumper sticker.” Later, Durkan accused the council of making the “arbitrary” decision to “just cut 50 percent because that’s what people put on a placard.” Police Chief Carmen Best piled on, accusing the council of wanting to eliminate the jobs of half the police department this year.

But is that narrative accurate? And is it fair of the mayor to suggest that the council went to a demonstration and was convinced to cut half the police department by a protest sign? Here are some of the primary factual claims the mayor and police chief made to reporters and the public on Monday morning, and an assessment of their accuracy.

Claim #1: The city council has made “made the arbitrary decision to defund the Seattle Police Department by 50 percent this year in 2020 and 50 percent next year” without any plan or consideration of the impacts such a “blunt cut” would have on the city’s ability to respond to crime and other emergency calls. “The city council decided in the space of hours … that they were going to cut the police department by 50 percent,” Durkan said Monday.

The seven council members who committed to making significant cuts to the police department all made slightly different statements, so it’s difficult to generalize about what each of them, individually, believe.

However, the one thing that was unambiguous during last week’s budget meeting was that in 2020, the council intends to cut not 50 percent of the total police department budget (a scenario Durkan has used to suggest the council would immediately shut down the entire police department as soon as the budget passes in August, since half the money for 2020 has theoretically been spent) but half of the budget that will remain for the last four months of the year, or about $65 million over the $20 million in cuts the mayor’s office has already proposed.

Council budget committee chair Teresa Mosqueda said as much last Wednesday, as has public safety committee chair Lisa Herbold, who also emphasized that she supports cutting the remaining police budget over a four-month period, not all at once.

Jackie Vaughn, an organizer with Decriminalize Seattle, which is working with the council to come up with a detailed plan for replacing some police functions with community-based organizations, said, “This scale-down of police will happen in a phased way, [and] the corresponding scale-up of community-based organizations would happen at the same time,” also “in a phased way, starting this year to prepare us for 2021.”

And council member Dan Strauss, who has said he supports eventual cuts of around 50 percent, called it “a false narrative to say that these approaches will not work and cannot work because they are not ready to [start] today. … The worst thing we can do is give organizations the responsibility of responding [to calls for service] without giving then the time they need to be successful.”

Like Durkan, who noted that her own proposal to cut the department by a total of 5 percent this year came about “in three weeks,” the council plans to come up with a plan to reallocate police dollars on a short timeline, but the cuts themselves will be phased in starting in September.

Moreover, since cuts that will involve actual layoffs will require a separate bargaining process with the Seattle Police Officers Guild (and some of the proposed changes will require approval by the court monitor overseeing the federal consent decree over the department), it’s possible, perhaps likely, that the biggest changes will be pushed back to the end of the year, possibly beyond. What the council is proposing is an acceleration, not an immediate, wholesale gutting of the department.

Claim #2: Cutting the police department means cutting cops… or perhaps an entire police precinct… or possibly no longer responding to 911 calls.

Durkan and Best have repeatedly made the alarmist claim that a 50 percent reduction to the police department’s budget would require them to “fir[e] half the police department overnight,” as Best put it Monday. At the press conference, Best said she wanted to “thank our officers for continuing to answer calls, running into the face of danger to offer aid, all while hearing a political conversation that half of them aren’t needed.” Best explained that “our budget is almost entirely personnel,” so cutting police would mean cutting an equivalent number of jobs.

The police department’s budget is actually 75 percent personnel; it has also grown tremendously over the years, usually outpacing the growth of the city budget as a whole. As Kevin Schofield of SCC Insight has demonstrated, the lion’s share of this growth has come not from adding officers but from salaries that have ballooned well beyond the average salary in Seattle, even before overtime is factored in. Simply eliminating overtime (such as the $6.3 million officers were paid for guarding the East Precinct like a citadel under siege during recent Hill protests) would reduce the department’s annual budget by more than $30 million.

As for the department being forced to “quit responding to 911 calls,” as Durkan put it, or eliminating the entire Southwest police precinct… Neither activists nor the council have proposed eliminating the 911 system. (Decriminalize Seattle’s plan, for example, calls for phasing in the replacement of 911 operators with civilian dispatchers.) And as Herbold pointed out during the city council briefing on Monday, the mayor and police chief do not have the authority to shut down a police precinct; only the council can make that kind of decision.

Claim #3: The city of Seattle has already taken the steps to “rethink policing” that other cities are just beginning to consider, so there’s no reason to make radical changes.

“We have done so much of what is being called for nationally. We’re already there,” Best said. Durkan said people pointing to Camden, NJ, which dismantled its police force seven years ago, as a model for the future of policing in America have “misunderstood” what happened there. After reassessing a costly and often violent force, Camden did “the things that we’ve been doing in the last 10 years in Seattle— deescalation training, outreach, mental health interventions.” In Minneapolis, where George Floyd’s murder sparked similar calls to disband the police, “all the things that they are [proposing], we have already done,” Durkan said. “The Seattle Police Department’s deescalation training is literally the model for the nation.” Continue reading “Does the City Council Want to “Fire Half the Police Department Overnight”? Mayor’s Office: Cutting Police by 50% This Year Would “Require the City to Abolish the Department”

On Wednesday morning, just before the council discussed options for cutting the Seattle Police Department budget by as much as 50 percent, senior deputy mayor Mike Fong sent a letter to council members urging them against such “blunt efforts.” Instead, Fong said, the council should approach the process of “re-envisioning policing” in a more “thoughtful” way, with a process of “structural reform” that would stretch well into 2021 and beyond.

“SPD has already spent half of its $400 million annual budget by now, so a $200 million cut (or 50% of SPD’s budget) would leave the department with zero budget remaining for 2020 and require the City to abolish the department,” Fong wrote.

A “$100 million reduction (or 25% of SPD’s budget),” he continued, “would mean immediate layoffs of up to 1,000 personnel leaving [police] Chief [Carmen] Best and the Seattle Police Department unable to conduct basic functions.  In addition, it would be irresponsible to make immediate cuts without any conceivable mechanism to stand up alternative models to achieve community safety. …  [T]he Executive does not think that simply making target cuts in SPD’s budget, without looking at the work or personnel being done/cut or the ability to have others do the work, will advance community safety.”

Durkan has consistently responded to demands that the city defund SPD by promising to “reimagine” the role of the police and brushed off protesters’ three high-level demands—immediately defund SPD by at least 50 percent, reinvest that money in community-based approaches to safety, and release all jailed protesters—as naive or unrealistic. Fong’s email, for example, says the cuts advocates are proposing are “not informed by any analysis or considerations of the underlying functions and services that SPD currently delivers.”

Instead of immediate cuts, Durkan has proposed a multi-step process before making any kind of structural changes to the department, including community “engagement and further [interdepartmental] analysis [that] will lead to additional recommendations for SPD reforms and alternative models for service delivery,” as Fong’s letter puts it.

This commitment to further “reform” and a process of community engagement led by the city is unlikely to satisfy advocates and abolitionists pushing for immediate cuts and systemic changes. Nor is it likely to satisfy the council, which was talking on Wednesday about phasing in cuts of perhaps $85 million—”the back of the envelope figure,” according to council budget committee chair Teresa Mosqueda—to be coupled with investments in community-based programs, including a new 911 system that would replace police with community responders on non-criminal calls.

By arguing for a slower approach and emphasizing reform and “re-envisioning” (as Fong’s letter puts it), the mayor’s office is committed to an incrementalism that many on the council—which amends and approves the mayor’s budget—have already rejected. Durkan’s proposal to cut $20 million from the police budget this year, as I’ve reported, only represents an additional cut of $4 million over what she proposed to the council before protests against police violence broke out in the wake of George Floyd’s murder in May. As SPD has acknowledged, the department has already met all its hiring goals for 2020, so Durkan’s proposed cuts won’t impact the number of police on the streets.

Like most police departments, SPD is a unionized institution of highly paid workers who are generally resistant to cuts or policy changes. Even getting officers to move so-called “mourning bands,” black tape strips used to signify the death of a colleague (in this case, a member of the State Patrol who died in March), to a place where they do not obscure badge numbers has apparently been a major challenge, despite legislation requiring them to do so.

In his letter, Fong suggests that union rules that protect officers with seniority would lead to the department cutting “some of our younger and most diverse officers” first, “defeating the hard work done to recruit officers that reflect and serve their communities.” Advocates coming forward with proposals for systemic change are unlikely to be moved by such arguments, especially when they imply that community organizations have not thought their own priorities and proposals through.

After CHOP Sweeps, Mayor Durkan Says City Will “Memorialize” Protests, “Reimagine Policing”

About 10 hours after Seattle police officers moved in to remove barriers, tents, artwork, and people from the Capitol Hill Organized Protest area this morning, Mayor Jenny Durkan, police chief Carmen Best, and other department heads called a press conference to explain their actions.

There was a lot to unpack. Why did the mayor issue the executive order in the pre-dawn hours, a time when most people living in tents in the area (and most reporters) would be asleep? Will the city prevent protesters from gathering at the East Precinct building in the future, and are they planning to use force? What will happen to the art and community gardens? Why did the city expel members of the media from CHOP, when the press is explicitly allowed to remain in an area after an order to disperse?

Durkan did get into a few specifics. For example, the mayor said the city would consider “memorializing” the protests by creating space for “a new garden, a speakers’ corner, or new art,” and would add a “community room in the East Precinct and things in and around Capitol Hill and the East Precinct.” It’s unclear how a community room could fit into the cramped layout of the East Precinct, leaving aside whether anyone would want to go there.

For the most part, though Durkan’s comments focused on lofty, nonspecific goals, like “statewide reforms,” “generational change,” and “investing in community.” The word “reimagine” appeared no fewer than seven times in Durkan’s 12-minute statement. “I will continue to refocus our energy on the hard but critical work to answer the voices demonstrating and demanding change, to reimagine, with Chief Best, what policing looks like in our city, and to invest in the true health and safety of our communities,” Durkan said.

Best, characteristically, described the CHOP in near-apocalyptic terms. “If you have watched the news footage you have seen how absolutely devastating the damage to this neighborhood is,” she said. Walking around the perimeter of the area, she said, “I was just stunned by the amount of graffiti, garbage, and property destruction.” She described residents and business owners coming out of their homes, like survivors of a natural disaster, to “profusely” thank her officers. “We don’t even know how much trauma” the protests caused to residents and business owners in the area, she said.

Durkan has reportedly been at odds with Chief Best in recent weeks, but there was no sign of division this afternoon. Instead, Durkan effusively praised the police chief and her officers (who Durkan described, in an apparent slip of the tongue, as “troops”), calling her “one of the best leaders in this country on policing” and crediting her “very steady hand” for this morning’s relatively smooth removal of tents, people, and barricades from the CHOP.

Durkan said she was expediting assistance to businesses in the area that experienced property damage or lost revenues, and had already spoken to the city attorney’s office about expediting their tort claims so that they could get financial reimbursement quickly. “I heard very clearly from them the pain of seeing their businesses close, the graffiti on their walls, calling back their employees but not yet able to open,” she said.

Asked whether she bore any responsibility for the two young men who have died in shootings in the area, Durkan declined to answer the question directly, calling the deaths “regretful” and saying that she hoped to meet with the victims’ family members. “We’ll have lots of opportunities to do after-actions on what people could have done at what junctures,” she added.

Best said the police would welcome peaceful protests outside the reopened East Precinct, but “there’s not going be lawlessness.” The police force is under a federal court that bars them from using “less lethal” weapons such as tear gas, pepper spray, and blast grenades, and the city council passed legislation barring the use of such weapons last month.

Earlier this week, city council public safety committee chair Lisa Herbold wrote a blog post revealing that Best had confirmed that one of the police department’s primary reasons for setting up heavily fortified barricades around the East Precinct was not true. The chief and mayor had previously claimed the FBI had informed them of specific threats to bomb or burn down the East Precinct. In fact, Herbold revealed, what Durkan previously described as “credible threats” were actually “a generalized assessment of threat to ‘police and government structures’ in Portland, San Francisco, and Seattle.”

The mayor and police chief have had to walk back a number of false or misleading statements about the protests, including claims that armed guards were forcing people to hand over ID and pay a bribe to enter (not true) and that police used force against protesters because one threw an “incendiary device” (it turned out to be a candle.) This afternoon, Best was not ready to let the threats to the East Precinct go. There were “threats to police precincts and to government facilities,” Best said. “We verified that and that information came from our local special agent in charge at the FBI.” 

The area that used to be CHOP will be closed to anyone who isn’t a resident or business owner for the next 10 days, Best said. According to at least one report on social media, police are requiring people to show identification to enter their own homes or businesses—exactly the scenario police department officials accused protesters of setting up last month.

Council Looks Inside the “Black Box” of the Seattle Police Department Budget

Anyone needing evidence that demands to “defund the police” by redirecting half their budget into community organizations have gained traction should watch yesterday’s City Council budget meeting (conducted via Zoom and available online), where council members began the process of what budget chair Teresa Mosqueda has called an “inquest” into the Seattle Police Department’s budget. The forensic look at a budget that council members called a “black box” comes at a time when the mayor and council were already looking for about $300 million in cuts, thanks to a recessionary revenue shortfall that has blown a hole in this year’s budget, and will almost certainly produce an austerity budget in 2021.

Wednesday’s meeting was mostly a deep dive into that budget, which totaled $409 million in 2020. Much of the information came from prior to the police actions against protesters over the last few weeks, which involved what will likely be massive overtime costs, since officers were working 12-hour shifts, as well as unknown costs for the huge number of tear gas canisters, “blast ball” grenades, rubber bullets, pepper spray, and other weapons deployed against protesters.

Still, the look into the police budget was illuminating. Some highlights:

• The overwhelming majority—75 percent—of the police budget pays for personnel, and most of those are sworn officers. Despite a hiring freeze in every other city department, SPD has hired a net total of 23 new officers this year (that is, the force grew by 23 after accounting for attrition). This hiring is currently on hold due to a lack of funding (and despite an upsurge in interest because of the recession), but council central staffer Greg Doss said it could pick up again in the fall—unless, of course, the city council reaches agreement to slow or stop police hiring before then.

• Sworn officers make dramatically more than their civilian counterparts at SPD, including those in positions the city council and Mayor Jenny Durkan have said are critical to police reform, such as community service officers. An average patrol officer, for example, earns a total compensation of around $150,780, not counting overtime. About 25 percent of that compensation consists of benefits, so a patrol officer’s annual salary is around $113,000. For a sergeant, that goes up to around $133,500.

In contrast, a parking enforcement officer with a total compensation of $96,850 actually takes home just over $50,000 a year, because benefits make up a full 48 percent of civilian SPD staffers’ salaries.

These six-figure salaries—which are significantly higher in practice for officers who, like the ones tear-gassing protesters on Capitol Hill last week, make extra money from working overtime—are worth considering in light of claims that it’s impossible to recruit officers from within Seattle city limits because they don’t make enough money to live here.

 

• More than a third of the budget for sworn officers goes to 911 response, a fact that Doss called “a statement of policy that the department is making.” Last year, Durkan announced the creation of a new emergency service called “Health One” to respond to non-emergency calls involving issues such as mental health and substance abuse. The program has never been expanded beyond downtown, however.

A common criticism of using armed officers to respond to 911 calls is that many of these calls are made because someone is in distress, not because there is a crime in progress. Many people call 911 in situations that demand trained mental health professionals or social workers, not armed officers with the authority to use deadly force against civilians.

• Overtime, mostly for sworn officers, costs the city about $30 million a year, although this year’s budget for policing protests could blow the lid off that number. In a typical year, about a third of that goes to providing security at events, including sports events. The city spends another $2.25 million a year on overtime for emphasis patrols in neighborhoods, an amount that has nearly doubled in the last year as Durkan has added more of these patrols. And security for the mayor herself costs another $393,000 a year.

• In a preview of upcoming presentations on what the police department’s overwhelming response to, and use of force against, protesters will cost the city, the police department provided a cost breakdown for every weapon and piece of protective equipment they use when responding to protests. Kevlar helmets? $531.02. Batons? $71.12 a pop. Those crazy-looking forearm plates that make cops tricked out in riot gear look like wannabe superheroes? A fairly affordable $22.99. “It seems that each officer goes out to each demonstration in about $900 in protective gear,” council member Tammy Morales observed.

The presentation, which you can read for yourself here, provides a baseline for the department budget and a framework for the council to start digging into how much SPD spent on the recent protests, from armored vehicles to overtime to weapons like tear gas, rubber bullets, and flash grenades. Next week, Mosqueda said, council will look at how other cities have moved toward community-based public safety models, followed by additional meetings on the 24th and July 1.
