Unanswered Questions from Durkan’s Housing Announcement

On Wednesday, city staffers, supporters of Mayor Jenny Durkan, and members of the media crowded into a  small black-box theater at the 12th Avenue Arts building on Capitol Hill to hear what was billed as a major speech outlining the mayor’s vision for affordable housing in Seattle. (Press, many of whom had expected the event would include an opportunity to ask questions, were relegated to a “reserved” row in the very back.)

Ultimately, the event—which consisted of a State of the City-style address outlining what the city has done on housing recently, followed by an announcement of two initiatives that were already in the works—didn’t make much news. Durkan said that Seattle plans to take advantage of a new state law allowing cities to use a portion of existing state sales tax for housing, by bonding against future revenues to get about $50 million for housing for formerly homeless people up front. And she said the city would extend the multifamily tax exemption program that gives developers a property tax exemption if they agree to set aside 20 percent of new units for low-to-middle-income renters for 12 years. (The city renews the tax break every three to five years).

In fairness, the MFTE announcement did include a bit of real news: Under Durkan’s plan, the city will cap rent increases at MFTE units at 4.5 percent a year. Under federal rules, potential (though not necessarily actual) rent increases for these units track to area median income—when median income goes up, say, 10 percent because a bunch of high-paid tech workers move into the city, rents for low-income people living in tax-exempt buildings can go up 10 percent as well, even though the people living in those units obviously aren’t seeing their incomes rise 10 percent every year. (In practice, huge annual rent increases for existing units would be out of scale with the overall market in many parts of town, although it does happen). Last year, the city used some creative math to freeze rent increases at MFTE properties to prevent apartment owners from raising rents at the rate of median income increases, but the 4.5 percent cap puts a firm limit on how much landlords can charge.

Otherwise, though, Durkan’s “Seattle Housing Now” announcement raised more questions than it answered. Here are some of those questions, along with a few potential answers.

• What’s going on with the pending sale of the Mercer Megablock?

Durkan provided a few sparse details about the pending sale of the Mercer Megablock, a three-acre city-owned site in South Lake Union that could bring in upward of $100 million. The mayor will likely announce a plan and buyer—reportedly Alexandria Real Estate Investment, Inc., a real estate investment trust that focuses on life science campuses—in the next two weeks. The mayor’s office recently briefed council members on the deal, sort of: Staffers reportedly showed council members a PowerPoint that contained few specifics, and took the document with them when they left.

What we do know from the mayor’s speech is that the new development will include some housing on site (the request for proposals for the project called for at least 175 rent-restricted units), and that the city will use some of the revenues from the sale to buy properties in areas with a high risk of displacement, to provide low-interest loans to struggling homeowners who want to build cottages in their backyards, and to fund homeownership opportunities.

What was unclear from Durkan’s pre-announcement announcement was how she will propose splitting up those revenues among programs that help low-income renters, middle-income workers (the “teachers, nurses and firefighters” that are a frequent Durkan talking point) and higher-income homebuyers and homeowners. Some housing advocates had argued that the city should hang on to the megablock property and build affordable housing on the site, or, failing that, invest heavily in housing for low-income people who are being driven out of the city by rising rents. It remains to be seen how much Durkan took their pleas to heart, but programs for homebuyers and homeowners tend to be aimed at people making as much as 120 percent of median income, or about $130,000 for a family of four. (For a single person, 120 percent of median works out to $91,000). If Durkan’s plan for the megablock money is skewed toward subsidizing people making six-figure salaries, it will likely come under fire from the council; on seeing an early draft of the mayor’s ADU plan, council member Lorena Gonzalez reportedly responded that the high-income subsidy (a loan product aimed at people making up to 120 percent of median) would end up disproportionately benefiting  white homeowners, not people of color facing displacement in areas like the Central District. Her office says they’ve asked the mayor’s office to do a race and social justice analysis of the proposal, and that they’ve said they will.

• Why didn’t the MFTE plan go further?

One perennial question about the multifamily tax exemption program is whether it results in enough  affordable housing to justify the cost, which amounts to about $26 million in lost taxes every year, according to the most recent program status report. The program ensures that between 20 and 25 percent of new units are available to people making between 65 and 85 percent of median income (a number that varies depending on the size of the unit and where it is in the city). The idea behind the 12-year tax break is that by the time the tax expires, new development elsewhere will have been built to meet demand at the top of the market, and the MFTE units will have depreciated in value to the point that rents will be affordable relative to the rest of the market. Because housing development hasn’t kept up with population growth, this hasn’t happened, raising the question of whether the subsidy is deep enough to justify the tax break for developers.

Options the mayor and her middle-income advisory council, which advised Durkan on the plan, could have proposed include lowering the income eligibility so that lower-income people could participate in the program, which would lower rents (currently, MFTE landlords can charge someone making 80 percent of median income $1,737 for a one-bedroom apartment, which is basically market rent); placing a more stringent cap on rent increases; or limiting the program to larger “family” units, on the grounds that the market is already producing lots of small units at rents basically equivalent to the units the program subsidizes with tax breaks.

• What’s up with the Uber/Lyft tax?

Durkan has been working since last year on a plan to tax Uber and Lyft rides to pay for a laundry list of transportation and housing programs, but the proposal has been slow to get off the ground. Uber and Lyft generally have opposed the plan, arguing that it won’t reduce congestion downtown, because ride-hailing services only amount to a small percentage of car trips downtown and because of a phenomenon called induced demand, where small reductions in congestion lead people to drive when they ordinarily wouldn’t have. The ride-hailing companies have called for broad congestion pricing on all downtown drivers, which (unlike a tax targeting them specifically) would require voter approval.

Durkan’s latest plan would reportedly fund new investments in housing with the tax. But  it’s unclear when—or whether—the mayor will actually release a final proposal. Another question, if Durkan does end up proposing the tax, is whether the revenues will go to capital investments (building new units) or operations and maintenance (the less flashy but critical work of running them). Permanent supportive housing units for very low-income people (like the ones that would be funded through the new sales tax revenues) are expensive to run because they (unlike regular apartments) require full-time staffing and case management. If the ride-hailing tax passes, that money could be used to build housing around transit stations (providing a nexus, sort of, to justify using a transportation tax to pay for housing) while the money from the sales tax can go toward O&M. Without the Uber/Lyft tax, that equation becomes more challenging.

Durkan’s latest plan would reportedly fund new investments in housing with a new tax on ride-hailing services. But  it’s unclear when—or whether—the mayor will actually release a final proposal.

• When is Durkan going to announce a new Office of Housing director?

Durkan told OH director Steve Walker (whose final day is today) he was out back in March. His deputy director, Miriam Roskin, went on sabbatical shortly after that and is not expected to return. Durkan has had four months to appoint a replacement for Walker, but has not yet done so. It’s unclear when the mayor will announce Walker’s replacement. In June, 30 housing advocacy groups sent a letter to the mayor outlining their values and recommendations for the hiring process—an effort, according to Puget Sound Sage policy and research analyst Giulia Pascuito, to “push back on [the] narrative we’ve seen from the Mayor’s office around ‘middle-income housing’ and to let the city know that advocates are paying attention” to the appointment.

• Why didn’t Durkan acknowledge state Rep. Nicole Macri (D-43), in her speech?

An oversight, perhaps—her official press release mentions Macri by name—but it was somewhat jarring that Durkan didn’t shout out one of the prime sponsors of HB 1406, the legislation that made it possible for the city to use sales tax revenues to fund housing, during her speech, which included praise for Macri’s co-sponsor, June Robinson, as well as house speaker Frank Chopp and state Sen. David Frockt.

Durkan’s Backyard Cottage Plan Would Have Kept Some Old Restrictions, Imposed New Ones

Mayor Jenny Durkan planned to propose her own accessory dwelling unit (ADU) legislation that would have restricted homeowners’ ability to build second and third units on their property, going far beyond the limitations in the legislation the city council passed unanimously yesterday afternoon.

The restrictions Durkan proposed would have been more lenient than previous regulations, which had resulted in just a handful of ADUs per year, but would have included many provisions requested by ADU opponents, including parking requirements for second ADUs, preserving the current owner occupancy requirement, and imposing new limits  on the size of backyard units.

Ultimately, as I reported this morning (item 2), Durkan did not propose her own legislation, and the bill the council passed yesterday does not include any of these restrictions. Still, Durkan’s ADU proposal gives a glimpse into her thinking about how much the city should limit how many people (and what kind of people) should be allowed to live in single-family neighborhoods.

This report is based on documents I received through a records request filed in March. The mayor’s office provided unredacted versions of these documents this morning.

First, the mayor set out her goals in drafting her own ADU legislation: “1. Encourage ADUs—especially affordable ADUs—throughout Seattle’s single-family neighborhoods. 2. Prevent speculative development and the demolition of existing single-family homes.” Her plan also laid out a set of “principles,” which included “Retain existing single-family neighborhood character.”

To those ends, here’s what the mayor’s proposal (which, again, was never sent to the council as legislation) might have done:

1. Imposed a cap of 1,000 accessory units permitted per year. (The legislation the council passed includes no such restriction.)

2. Required homeowners building a second ADU to sign a legally binding document stating that they would never use that ADU as an Airbnb (a new restriction that would allow someone to own two houses on adjoining lots and rent one as an Airbnb, but would ban a neighbor with two ADUs from renting out their backyard unit).

3. Required two years of continuous ownership before a homeowner could build a second ADU, such as a backyard cottage in a house that already has a basement apartment. This restriction went further than council member Lisa Herbold’s proposal for a one-year ownership requirement, which failed; the legislation the council passed does not include any ownership-related restrictions on ADU construction.

4. Required homeowners to build one off-street parking space when they build a second ADU. Notes from staff on the mayor’s proposal indicate that “many infill parcels, especially those without alley access, cannot easily accommodate off-street parking, making this requirement a significant impediment to ADU development.” The legislation that passed yesterday includes no parking mandate.

5. Imposed a new floor-area ratio (a measure of maximum density) on detached units while eliminating the previous minimum lot size of 5,000 square feet. Although getting rid of maximum lot sizes sounds like a good thing, in practice, this measure would have little practical impact while imposing a new restriction on what people on smaller lots could build. I’ve explained this in a bit more detail below*, but the impact would be that any lot smaller than 5,000 square feet would have to build a backyard unit smaller than 1,000 square feet—and the smaller the lot, the smaller the cottage. In contrast, O’Brien’s legislation allows backyard cottages of up to 1,000 square feet on all lots, subject to the city’s existing maximum lot coverage of 35 percent.

Although getting rid of the minimum lot size entirely might seem preferable, the impact would be tiny—according to the city, just 7 percent of the single-family lots in Seattle are smaller than 3,200 square feet, and ADUs on very small lots are unlikely for the reasons I explain below.

6. Required a homeowner or a homeowner’s family member to live on the property for at least six months out of every year. O’Brien’s legislation got rid of the existing six-month owner occupancy requirement because it effectively banned renters from living in at least one of the units on lots with an ADU (suggesting that backyard-cottage renters require owner supervision.) Durkan’s proposal would have continued to prevent renters from occupying every unit on lots with ADUs, but allowed family members to serve as owner proxies. The proposal doesn’t define “family member,” but other elements of the municipal code limit the number of people who can live on a single lot unless they are “related,” a term that is undefined in the code.

Because I filed my request for these documents in March, they don’t include any discussions that happened after April 1 that might shed light on why Durkan decided not to propose her own ADU legislation. The mayor’s office did not immediately respond to a question about why they dropped the proposal this afternoon.

*Two hypothetical examples illustrate the impact of this change on lots of two different sizes.

A homeowner with a 4,000-square-foot lot could cover a total of 1,400 square feet of that lot with buildings, subject to the maximum height limit of about 30 feet. That could include, say, a 1,600-square-foot two story house (covering 800 square feet of the lot) and a two-story, 1,000-square-foot backyard cottage (covering 500 square feet). Under Durkan’s proposal, though, the backyard cottage would also be restricted by the 0.2 FAR, limiting it to a total of 800 square feet no matter how the rest of the lot is configured. This is the limit that existed before O’Brien’s legislation raised it to 1,000 square feet, so in this case Durkan’s proposal would have preserved the old status quo.

A homeowner with a 2,500-square-foot lot, who couldn’t build a backyard cottage under the rules adopted yesterday, would theoretically be able to do so under Durkan’s proposal. But the restrictions would make this exceedingly unlikely, because the backyard cottage would be limited to a total of 500 square feet—on a lot where only 875 square feet can be developed in the first place. Playing this out presents some very unlikely scenarios, such as a tiny front house towered over by a narrow two-story backyard tower. The point is, the effect of these restrictions would have been primarily to limit the size of backyard units, not to expand homeowners’ ability to build them.

Morning Crank: “I Have Not Seen Any Speculative ADU Bubble”

1. The city council finally adopted legislation to loosen regulations on backyard and basement apartment construction Monday, 13 years after the city allowed homeowners to build backyard cottages in Southeast Seattle on a “pilot” basis in 2006.  The city’s analysis found that the new rules, which would allow homeowners to build up to two accessory units (such as a basement apartment and a backyard cottage) on their property, will add up to 440 new units a year across Seattle, or about one unit for every 80 acres of single-family land.

The city expanded its initial backyard cottage pilot to include the rest of Seattle in 2009, but it never took off in a major way, thanks in large part to restrictions on lot and unit size, owner-occupancy requirement, and parking mandates that made accessory dwelling units, or ADUs, difficult and expensive to build. Efforts to make it easier to build second and third units ran against the usual objections from single-family homeowner activists, who claimed that changing the law would turn Seattle’s exclusive neighborhoods into triplex canyons, and from left-leaning development opponents, who claimed  that loosening the rules would lead to a frenzy of speculative development, with builders snatching up affordable single-family rental houses and destroying them to make way for new houses with two additional units, which they would rent out at higher prices or turn into Airbnbs.

Litigation by a group of homeowner activists dragged the process out for years, but the city prevailed in May, enabling the legislation to finally move forward. Although council members generally supported the proposal, some of them wanted to add new restrictions, such as owner occupancy and ownership requirements and even a ban on leasing the units as short-term rentals, which would have subjected backyard cottages and basement apartments to more stringent anti-Airbnb rules  than any other kind of housing in the city.

Ultimately, the only one of those amendments that saw the light of day on Monday was Lisa Herbold’s proposal to require homeowners to own a property for one year before building a second accessory unit—a provision Herbold said was necessary “to address the speculative market that will flip these units”—with even socialist council member Kshama Sawant saying that she saw no reason for the restriction. While she is concerned about “corporate developers” building luxury apartment towers, Sawant said, “I have not seen any speculative ADU bubble anywhere.”

The legislation, which Sightline called “the best rules in America for backyard cottages,” passed 8-0, with council member Bruce Harrell absent.

2. Often, when the council passes a piece of legislation they have been working on for some time, Mayor Jenny Durkan sends out a press release praising the council for passing “the Mayor’s legislation.” That didn’t happen with the ADU bill that passed yesterday—not because Durkan didn’t have her own version of the proposal, but because she never sent her own version of the ADU legislation to the council. Instead, after a team of staffers spent months working on draft legislation and crafting an outreach plan for an alternative proposal, the mayor apparently decided to support O’Brien’s legislation after all.

It’s hard to quantify how much staff time the mayor’s office and city departments dedicated to drafting legislation that never saw the light of day, but the sheer volume of communications in the first three months of 2019 suggests it was a substantial body of work. (I filed my request at the end of March and received redacted records in mid-June, which is why I don’t have any documents dated later than March 31).

At the moment, it’s also hard to know what problems Durkan had with O’Brien’s proposal, since most of the documents her office provided about her strategy and legislation look like this:

I would show more, but it just goes on like this.However, series of text messages between two mayoral staffers that were provided without redactions shows that one of the changes Durkan was considering was an even longer ownership requirement than what  Herbold proposed—two years, rather than one, before a homeowner could build a second accessory unit.

I’ve asked the mayor’s office for unredacted versions of the documents I received in  and will post more details about her proposal  when I receive them. In the meantime, here’s one more page from those redacted documents—this one a list of ideas the mayor’s office had to “further allay concerns” about “speculative development.”

Afternoon Crank: Bike Lanes and Backyard Cottages

1. City council member Abel Pacheco, who is filling out former District 4 representative Rob Johnson’s term,  did some political calculus before deciding to seek the temporary appointment rather than staying in the crowded race for a four-year term, but urbanists are probably wishing they could have him longer.

Yesterday, Pacheco was instrumental in shooting down two amendments from council member Lisa Herbold that would have, respectively, barred homeowners who build accessory dwelling units (such as a basement apartment) from renting them out on a short-term basis through a platform like Airbnb, and required a homeowner to live on the property for at least a year before building a second accessory unit (such as a backyard cottage.)

Herbold said banning Airbnbs in ADUs would prevent the construction of ADUs for the purpose of providing short-term rentals rather than as “rental housing” for Seattle residents. Pacheco countered that in his district (which includes the University of Washington and Children’s Hospital) a high percentage of renters only need housing during the school year or a short-term residency, and that Herbold’s amendment would make it impossible for them to rent their units during off seasons. (City law limits Airbnb operators to two units—one inside their primary residence and one offsite).

“Having lived in two ADUs, I know how great an opportunity it is to provide for folks not just in my district but around the city,” Pacheco said. Mike O’Brien, who sponsored the legislation and has shepherded it through the council through years of legal challenges, added that if Herbold’s amendment passed, it would put ADUs in a separate category from all other types of rentals, so that someone who owned two houses side by side could rent out the second house as a short-term rental, but someone who owned a house and built a garage apartment on the same lot could not. “I don’t think that’s necessarily fair,” O’Brien said.

The legislation, which passed out of committee 5-0 (council member Kshama Sawant, who might have voted with Herbold on her amendments, was excused to go to a labor rally), will move forward to the full council on Monday, July 1.

2. Pacheco also asked some blunt questions of Seattle Department of Transportation director Sam Zimbabwe during a committee discussion about the diminished Bicycle Master Plan, which SDOT is now describing as an “accountability document” that only promises what the city can actually pay for. (The bike plan was scaled back in response to higher cost estimates on a number of projects that were supposed to be funded by the Move Seattle Levy. After bike advocates protested that the bulk of the projects that got cut were top-priority projects in Southeast Seattle and downtown, SDOT updated the plan by putting some of those projects back in as areas for “study,” while also scaling back a long-planned, and already delayed, protected bike lane on Fourth Ave. downtown). Pacheco asked Zimbabwe why the latest version of the Fourth Avenue bike lane is only northbound, rather than the two-way bike lane that has been in every previous version of the plan.

Zimbabwe said that SDOT has every intention of “designing a two-way facility, but the traffic impacts of that, and frankly the costs of that, have never been fully studied,” including the cost of signal infrastructure to allow left-hand turns across the bike lanes from Fourth Avenue. “That wasn’t part of the planning process previously,” he said. “We are committed to designing [it] to better understand what the cost implications are.”

After the meeting, I asked Zimbabwe how it was possible that there was no design yet for Fourth Ave., given that it was originally supposed to open at the beginning of 2018. He said that his understanding was that the two-way bike lane was “designed to about 30 percent [without] a full budget development. … We don’t have constructable plans right now.” SDOT’s previous reasons for delaying the two-way bike lane have included costs, impacts on transit during the “period of maximum constraint” downtown, traffic impacts during major traffic incidents such as when a fish truck overturned on SR 99 in 2015, and (most recently) “parking impacts.”

I also asked Zimbabwe about whether SDOT planned to revisit its decision to eliminate another long-planned bike lane on 35th Ave. NE in light of two recent collisions between drivers and vulnerable users (a cyclist and a motorcyclist, who was killed by a driver in a pickup truck turning left into his path). On Monday, as I first reported on Twitter, council member Sally Bagshaw said she was horrified by videos showing drivers zooming past cyclists at close range, using a newly added turn lane as a passing lane.

Zimbabwe said there were no plans to revive the protected bike lane—which was included in earlier versions of the Bike Master Plan but killed by Mayor Jenny Durkan after “concerns … from the community” —but that SDOT was “making some tweaks to make sure pedestrian crossings are safe” and adding flexible barriers to create “turn pockets at the intersections to keep [drivers] from overtaking” cyclists. In a statement to KING 5, SDOT spokesman Ethan Bergserson said that the upcoming changes, “as well as any others, should not be viewed as an indication of shortcomings but as part of SDOT’s ongoing data-driven approach to roadway improvements.”

Families Come In All Sizes. Housing Choices Should, Too.

Seattle needs thousands of homes for people of all ages, incomes and backgrounds over the next 10 years. Families come in all shapes and sizesand housing choices should, too. Some families love the convenience, coziness and price of an accessory dwelling unit. There’s a lot of names for a second home within, or next to, an existing house: Granny Flats, Fonzie Flats, Pool Houses, Coach Houses, Kitchenette Units, Backyard Cottages, Basement Apartments, and so many more.

MOAR – More Options for Accessory Residents—supports more accessory dwelling units for the following reasons:

  • Climate Change: (D)ADUs are one way to add new neighbors to areas with frequent transit service. This means that people can live closer to their jobs, cultural communities, and more—which means less sprawl and less dependence on cars. (D)ADUs are also much more energy-efficient then single-family houses, cutting carbon emissions by as much as half.
  • Walkable Communities: (D)ADUs support small businesses by making it possible for more people to live within walking, biking, and easy transit distance of local mom-and-pop shops.
  • Aging in place:  The new legislation has built-in flexibility for people who want to build a one-story backyard unit, making it much easier to create opportunities to age in place. In cities that make it easy to build backyard apartments, many people move into the backyard cottage and rent out the front home to offset rising property taxes.
  • Intergenerational Living: (D)ADUs help create additional living spaces for children who need an affordable place to stay during or after college, aging parents, a relative who can babysit or fill in for child-care needs, or a relative who might need at-home care.
  • Parking Requirements: Let’s prioritize housing for people, not storage for cars. The proposed legislation takes away the requirement that homeowners add a new parking space to build a second unit. And it doesn’t count interior parking or storage space against the size limit. 

  • Affordability: Right now 75 percent of Seattle is off limits to new neighbors who can’t rent a whole house or come up with a down payment to buy one. ADUs & DADUs are one way to induce mixed-income neighborhoods and more equity without changing the zoning.
  • Land Owners, Home Owners, and Neighbors Who Rent: Right now, 20 percent of Seattle’s single-family houses are occupied by renters. Under the current rules, property owners with ADUs must live on site six months out of every year—a biased policy that prevents renters from accessing this housing and takes away property owners’ flexibility to live elsewhere. The proposed legislation will allow anyone, including renters, to live on a property with an attached or detached ADU. 
  • Out-of-scale homes: Right now, the city incentivizes removing small houses so the largest possible house—sometimes referred to as a “McMansions”—can be constructed. Based on census data, the average household size is declining but the average square footage of a house isn’t. The legislation would limit the size of new homes while encouraging ADUs and DADUs by not counting second and third units against development limits.

Adding 2,000 additional homes over the next ten years by reforming the city’s approach to ADUs is a very small step on the path to making our region affordable for all our neighbors, including the ones who haven’t moved here yet. Morning Crank: “As a Seattle Native”

If we allow backyard cottages, it could open the door to neighborhood character-destroying duplexes like this

1. The city’s hearing examiner heard final arguments late last month in the latest effort by Queen Anne activist Marty Kaplan to prevent homeowners from building mother-in-law units and backyard cottages (accessory dwelling units, or ADUs) on their property. (Kaplan has been filing legal challenges “as a Seattle native” since 2016, arguing that allowing two ADUs—e.g., a backyard cottage plus a basement apartment—will destroy the character of Seattle’s exclusive single-family neighborhoods and lead to rampant speculation by developers). The preferred alternative (there’s no actual legislation yet, since the proposal has been locked up in litigation) would also remove the existing parking mandate; establish restrictions on the size of new single-family houses in an effort to thwart McMansion-style developments; and lift the current owner-occupancy requirement in favor of a new rule requiring that a homeowner who has one ADU and wants to build a second must own the property for at least a year before beginning to build.

If the hearing examiner rules that the environmental review of the ADU proposal, sponsored by council member Mike O’Brien, was adequate, the council can move forward with actual legislation as early as next month. Their goal is to finalize and vote on the legislation no later than August.

But hold up. Mayor Jenny Durkan reportedly hopes to negotiate with the council to get some amendments to the legislation, starting with the owner-occupancy requirement. ADU opponents, including Kaplan, have argued that allowing up to two secondary units on a lot will open single-family neighborhoods up to “speculative development,” unless the city mandates that any homeowner who wants to build an ADU has to live on that property in perpetuity. The specter of developers descending greedily upon single-family property for the privilege of building a secondary unit (and then, after owning the property for a full year after that, building a third) might strike anyone familiar with Seattle’s existing real-estate market as absurd, but to spell it out: There’s no evidence of a speculative boom in backyard apartments in other cities, like Portland and Vancouver, where they’re easier to build; the scenario in which developers build backyard apartments, then sit on those properties for the year before building another unit, makes little financial sense; and fans of missing-middle housing for middle-class people who can no longer afford to buy anything in Seattle might consider a little development a good thing. Nonetheless, Durkan reportedly wants to put owner-occupancy requirements back on the table, and to reopen the discussion about parking requirements. Council sources say the parking idea in particular is probably a nonstarter.

The hearing examiner is expected to make his ruling by mid-May.

2. The city’s Human Services Department found itself on the defensive in late February, after Mayor Durkan claimed in her state of the city speech that the city had “helped more than 7,400 households move out of homelessness and into permanent housing.” As I first reported, that number was misleading at best—the city actually counted 7,400 exits from programs, a number that almost certainly overstates the number of actual people who have gotten out of homelessness because it counts every program as an exit (so that, for example, a household of two who stopped using five homelessness programs would count as five “exits.”)

At the time, HSD officials and the mayor’s office expressed frustration to reporters who asked questions about the discrepancy, insisting that they should have “known all along” that when the city said “households,” they really meant “exits from programs,” and that reporters should focus not on what the numbers specifically represent, but on the fact that they’re going up.  “No matter how you look at it, it’s getting better,” HSD deputy director Tiffany Washington said. Nonetheless, several other reporters considered it newsworthy that the city did not know how many people it was actually helping, despite the city’s insistence that it was not a revelation.

Even as the city was telling reporters that they shouldn’t have been surprised that “households” does not mean “households,” internal communications between mayoral and HSD staffers, which I obtained through a records request, show that prior to the mayor’s press conference to discuss the numbers the Monday after my story ran, the city decided to remove all references to “households” in a talking-points memo bound for the mayor’s desk.

The shift was fairly abrupt. On Thursday, February 21, for example, HSD spokeswoman Meg Olberding wrote in an internal email that one of the department’s top speaking points was “30% More Households Exit (Maintain) to Permanent Housing.” One day later, and several hours after my initial story on the “households” vs. “exits” discrepancy, the mayor’s homelessness advisor, Tess Colby, emailed the mayor’s office and HSD staff to say that she had “revised the memo to Mayor to replace ‘HHs’ with ‘exits’ solely in the interest of precision.”

In all, 12 references to “households” were removed from the memo. For example, the top bullet point, which referred to “the 7,400-goal … for exiting households from the system and maintaining permanent supportive housing clients” was changed to “exits from the system and maintaining permanent supportive housing clients.” A sentence that originally read, “In 2018 431 Native American/Alaska Native households exited  homeless services programs …and 2,979 Black/African Americans households exited homeless services programs” was changed to read, “In 2018 there were 431 exits among Native Americans/Alaska Natives from homeless services programs …  and exits of Black/African Americans increased to 2,979.” And a reference to enhanced shelters “exiting nearly twice as many households” in 2018 than the previous year was changed to say, “Exits to permanent housing increased nearly two-fold.”

These changes may seem minor, but they (and their timing) are significant. The mayor’s office got called out for overstating its success in responding to homelessness. Publicly, they went on the defensive, telling reporters they were making a big deal out of nothing. Privately, though, the mayor’s office appeared to realize the confusion was warranted.

3. Speak Out Seattle, a group that fought against the head tax for homelessness, opposes tiny house villages and encampments, and backed an initiative to ban safe consumption sites,  held a forum for District 2 council candidates Thursday night, although only four of the seven declared candidates decided to attend. (Two, Tammy Morales and Christopher Peguero, had previously stated their intent to boycott the forum). The remaining candidates were bounce-house rental company owner Ari Hoffman, Socialist Workers Party Henry Dennison, Seattle Police Department crime prevention coordinator Mark Solomon, and Rainier Valley community organizer Phyllis Porter.

I live-tweeted the event, which was attended by an incongruously white audience given that D2 is the least-white district in the city. I’ve included a few key moments below, and collected all my tweets in a Twitter moment here.

Morning Crank: Rethinking the Vaunted Neighborhood Plans of the ’90s

In a move that could reveal hard truths about the city’s vaunted 1990s-era neighborhood planning process, city council member Teresa Mosqueda wants the city to do a full race and social justice analysis of the so-called urban village strategy, which concentrates all new development in narrow bands near arterial streets and preserves two-thirds of the city exclusively for detached single-family houses. The urban village strategy was crafted more than 20 years ago by neighborhood groups that were dominated, then as now, by white homeowners who wanted to ensure that the “character” of their neighborhoods would remain unchanged. The monoculture of exclusive single-family zoning, and the “character” of Seattle’s suburban-style neighborhoods, is a legacy of redlining—the process by which people of color and renters were systematically excluded from many parts of Seattle.

Introducing her proposal at Thursday’s council budget hearing, Mosqueda noted that at the time the urban village strategy was adopted, in 1994, there was no Race and Social Justice Initiative. That came in 2004, and “it wasn’t until 10 years after that that the race and social justice strategy was expanded to include policies that impact the urban environment,” Mosqueda said. “One of our questions is whether or not we are investing in urban villages equitably throughout Seattle. … I’m interested in whether or not we are crafting policies that are allowing more people to live here.”

The city recently completed a race and social equity analysis of a proposal that would make it easier for homeowners to build second and third units on their property. That analysis found, not surprisingly, that allowing more backyard cottages and mother-in-law apartments will disproportionately benefit white Seattle residents, because most homeowners in Seattle are white. (See chart, below). However, the analysis (like the environmental impact statement the city recently completed on the proposal) also found that allowing more backyard and basement apartments wouldn’t contribute to displacement; and it suggested several steps the city could take to make it easier for homeowners of color to build accessory units, such as pre-approved building plans and assistance with permits and financing. A race and social justice analysis of the city’s urban village strategy would likely reach similar conclusions—restricting development to the areas directly adjacent to major streets helps drive up housing prices and lock lower-income people and people of color out of many neighborhoods—and point to more radical solutions. Neighborhood activists, in other words, are likely to oppose it. Channeling them Thursday, council member Sally Bagshaw raised objections to Mosqueda’s proposal, which she said might be “duplicative” with work the city has already done. (It isn’t.) “Good heavens, this feels like déjà vu to me,” Bagshaw said. Council member Rob Johnson, who supports Mosqueda’s idea in principle, said, “I think that the issues that council member Mosqueda brings up are very appropriate for us to consider,” but suggested that the council might fund it later in the year.

Neighborhood activists, ironically, actually raised the need for race and social justice analysis in their ongoing attempt to prevent the city from implementing its Mandatory Housing Affordability strategy arguing (disingenuously) that the city didn’t do a race and social justice analysis of the proposal to allow slightly denser development on 6 percent of the city’s single-family land. (Developers building under the new rules would be required to build affordable housing on site or pay into an affordable housing fund. The new rules have gone into effect in denser parts of the city, including downtown). They’re still fighting that one, a year after the council passed the legislation.

It’s hard to quantify how much funding for affordable housing the city has lost because single-family activists have locked MHA up with a series of seemingly endless appeals. Hard, but not impossible. About a week ago, Johnson asked the city’s Office of Planning and Community Development to do an analysis of how much money the city has forfeited from developments that would have happened under the new rules if they had gone into effect a year ago. “I’ve asked them to run the numbers about projects that might have vested under MHA, had we adopted it when the bill was first sent down to us,” Johnson told me yesterday. “As you can imagine, vesting times really vary, so  it’s difficult analysis for us to do.” However, Johnson hopes that by looking at the development cycle that just ended, the city can get a sense of how much affordable housing Seattle has foregone while activists have filed appeal after appeal.

Speaking of appeals, the Queen Anne Community Council filed another one against the accessory dwelling unit proposal yesterday, arguing that the proposal—which would add about 2600 basement and backyard apartments, citywide, over what will likely be built anyway—”ignores, disrespects, and eliminates the citywide Neighborhood Plans.” The appeal, filed by Queen Anne homeowner Marty Kaplan and his attorney, Jeff Eustis, reiterates Kaplan’s claim that the plan will upzone the entire city, effectively turning single-family neighborhoods into wall-to-wall apartment blocks. The complaint concludes, spaghetti-at-the-wall style, by listing a litany of supposed ills that will befall neighborhoods if the city allows a few thousand more backyard and basement units in a city of 700,000: the “displacement and destruction of older, more modest and
affordable housing, the displacement of populations, the loss of historic buildings, the change in neighborhood character, the unstudied stresses on existing utilities and infrastructure, the amount of available on-street parking. and the ability of
residents and emergency vehicles to circulate through neighborhood streets, and other population pressures among many more.”

Johnson notes one potential bright side to all this delay. If the appeals of MHA and the accessory dwelling legislation drag on indefinitely,  he says, the city’s planning department will have more free time to do the kind of analysis of single-family zoning that Mosqueda is requesting.

Morning Crank: Prohibitive and Frustrating

1. Marty Kaplan, the Queen Anne activist who has filed multiple legal challenges to delay new rules that would allow homeowners to add up to two additional units to their property, is reviewing the final environmental impact statement (EIS) on the proposal and deciding whether to press on with his appeal, according to an email he sent to members of the Queen Anne Community Council last week.

In the email, Kaplan notes that the group has until October 18 to file an appeal, and suggests that they adopt the following motion: “If the ADU FEIS is found by Martin Kaplan to be deficient in representing a comprehensive environmental study as required by the Hearing Examiner in our former appeal and outlined with our letter of comment pertaining to the ADU DEIS, then Martin Kaplan is hereby authorized to file an appeal on behalf of our QACC.” Kaplan has not said whether he plans to continue pursuing his case against the city, or whether thousands of Seattle homeowners will finally be able to build secondary units on their properties.

The FEIS, released last week, added a fourth, preferred, option to the three alternatives in the draft document, which I covered in depth in May.  If the city adopts the preferred option, homeowners will be able to build up to two accessory dwelling units (ADUs) on their property—two attached (mother-in-law) units, or one attached unit and one detached apartment, subject to maximum rear lot coverage of 60 percent. (The total maximum lot coverage—35 percent for lots over 5,000 square feet, or 15 percent plus 1,000 square feet for lots under 5,000 square feet—will remain the same). The minimum lot size for building an additional unit will be reduced from the current 4,000 square feet to 3,200 square feet, and rules requiring homeowners to build an extra parking spot for each unit, and to live on the property at least six months a year, will be lifted. However, in an odd concession to opponents like Kaplan, homeowners who want to build a second ADU won’t be allowed to do so until they’ve owned the property for at least a year. Both attached and detached units could be up to 1,000 square feet—up from the current 800—and up to 12 unrelated people could live on a lot with three units, allowing (for example) a house, basement apartment, and backyard cottage with four roommates each on a single lot. (This has been a particular sticking point with single-family activists who say so many unrelated people shouldn’t be allowed to live on a single lot). Unlike one of the alternatives the city originally considered, the preferred alternative would not require homeowners to pay into a city affordable housing fund if they want to build a second accessory unit.

Finally, in an attempt to mitigate the spread of new McMansions in Seattle’s single-family areas (and encourage homeowners to add density instead), the proposed new rules limit new houses to just 2,500 square feet or a 50 percent floor-area ratio (FAR), whichever is larger. FAR is the ratio of the square footage of a building to the lot that it’s on. A 2,500-square-foot house on a 5,000-square-foot lot would have a floor-area ratio of 0.5, even if that 2,500 square feet is spread over two stories; so would a 3,600-square-foot house on a 7,200-square-foot lot, and so on.

Because the the city used slightly different assumptions in calculating the number of second and third units that will be produced if the new rules move forward (assuming, for example, that homeowners will have access to pre-approved standard plans for accessory units, and that the city will lower other regulatory barriers that drive of the cost of adding extra units), the new preferred alternative is expected to lead to slightly more units than any of the options the city previously considered. Overall, the preferred alternative would produce about 2,460 more accessory units than the no-action alternative (a total of 4,430), which would correspond to about 3,960 additional residents in single-family areas, spread across Seattle (6,645, compared to 2,955 under the do-nothing alternative.)

2. Saul Spady—the grandson of Dick Spady, of Dick’s Burgers, and one of the most vocal opponents of the “head tax” for homelessness that was overturned earlier this year—has been busy. Since September, Spady has reportedly been meeting with prospective city council candidates for 2019, including Erika Nagy of Speak Out Seattle and Ari Hoffman, who unsuccessfully sought for $230,000 in “homeless-related damages” to a cemetery in North Seattle. On Friday, Hoffman officially filed to run for council in District 2, the South Seattle council seat currently held by three-term incumbent Bruce Harrell. Spady, whose parents spend decades advocating for charter schools,  sent out an email in September seeking funds to defeat the upcoming Families and Education Levy renewal and to recruit “common sense candidates” to defeat council incumbents—a solicitation that could put him at odds with city and state election  laws.

In addition to his work recruiting local candidates, Spady has an upcoming speaking engagement in front of members of the Washington Policy Center, a conservative/libertarian-leaning think tank. The group’s annual Young Professionals Dinner includes speeches and “exclusive Q&A sessions” with two keynote speakers: Spady, and former US House Speaker-turned-Trump apologist Newt Gingrich. Non-member tickets start at $75.

3. Speaking of potential council candidates: A few other names that are starting to circulate in the rumor mill for 2019: Former Nick Licata campaign manager Andrew Lewis (District 7, currently held by Sally Bagshaw); former Seattle police chief Jim Pugel, also in District 7; Beto Yarce, a onetime undocumented immigrant and entrepreneur who now runs a nonprofit that helps launch small businesses (District 3, held by Kshama Sawant); and community organizer Tammy Morales, who came within 400 votes of beating District 2 incumbent Bruce Harrell in 2015 and is widely expected to run for his seat this year. Bagshaw is widely expected to step down this year, as is District 4 council member Rob Johnson. Sawant has given no indication that she won’t seek reelection, and Harrell’s plans are currently anybody’s guess.

4. Mayor Jenny Durkan’s proposed 2019 transportation budget includes new investments in “adaptive signal” technology—a term that typically describes systems that monitor where vehicle traffic is heavy and adjust light cycles to give traffic more time to get through crowded intersections. Seattle has a system like this in place on Mercer Street in South Lake Union, which “detects cars in each lane at every intersection … determines traffic levels, predicts the flow of traffic, and adjusts the amount of time available to each movement through the intersection.” These marginal drive time improvements often come at the expense of pedestrians, who are forced to endure long waits as the city gives cars extra time to drive through intersections (and to dash across the street on short walk cycles designed for maximum vehicle movement), which is one reason the National Association of City Transportation Officials says that “long signal cycles … can make crossing a street or walking even a short distance prohibitive and frustrating, [which] discourages walking altogether,” and recommends adaptive signals only for suburban areas.

However, the new budget also includes funding for a pilot project at the University of Washington that could at least start to restore the balance between pedestrians and cyclists and the almighty car. The project, which will also be funded by the UW and the Federal Highway Administration, will test passive pedestrian detection and pedestrian counting—technologies that could eliminate the need for walkers to push a “beg button” to cross the street and allow longer crossing times for large groups of pedestrians, respectively. (One way to obviate the need for a beg button, of course, would be to assume there are always pedestrians trying to cross the street in busy areas like South Lake Union and the U District and provide a walk cycle during every green light, as pedestrian advocates across the country have been requesting for years, but baby steps.)

The pilot project will also test an app that will enable cyclists to trigger signals at intersections that equipped with weight-sensitive sensors in streets, which don’t detect vehicles lighter than cars. Cyclists (and, presumably, motorcyclists, who are also usually too light to trip pavement-embedded signals) will be able to download an app that will notify any signals equipped with the new technology that a bike is present, causing the light to change even if there aren’t any cars around. This “solution,” of course, will only work in the limited number of signals near the University of Washington that are equipped with detectors, and for cyclists who download the app and have it running on their phones when they approach those intersections.

This post has been edited to reflect that maximum lot coverage rules will remain the same under all accessory dwelling unit options; the change is to maximum rear yard coverage, which would increase to 60 percent for new detached accessory dwelling units.

Supporters Outnumber Naysayers as Backyard Apartments Move Closer to Reality

A couple of weeks ago, I schlepped up to the Queen Anne public library to watch a presentation by Marty Kaplan, the architect and homeowner who sued the city to stall a proposal that will make it easier for homeowners to build backyard cottages and basement apartments on their property. Kaplan’s lawsuit effectively forced the city to do a full environmental review, or Environmental Impact Statement (EIS), on the policy—a review that concluded that not only do garage apartments not harm the environment, they provide significant benefits, such as reducing the number of single-family homes that are torn down and redeveloped as McMansions and improving equity in neighborhoods that were originally designed to keep poor people of color out.

The “full build-out” scenario, included in the EIS for illustrative purposes only, shows massive single-family houses on every lot, an outcome that is already allowed under current rules.

Kaplan’s presentation, delivered to several dozen members of the Queen Anne and Magnolia Community Councils, was ostensibly about the results of that review, but anyone who actually read or even skimmed the 364-page document would be understandably confused by his interpretation of the report. The city’s preferred alternative, Kaplan claimed, would lead to the development of “three houses on every lot,” with “12 [unrelated] people on every lot. … If you’ve got a big family, 20 people could live there, I guess.” And without rules requiring homeowners to provide parking for all those new tenants, Kaplan continued, “if there’s 12 people living on site and ten of them own cars, then they’re going to park them in the neighborhood,” contributing to an already untenable parking situation in neighborhoods like Queen Anne. (As he said this, I thought of the four parking spots directly in front of the library that I had walked past on my way into the meeting.) In the background, as Kaplan spoke, was a slide of the city’s theoretical “full build-out” scenario (above), which Kaplan characterized as what the city hopes will happen within the next few years. Moreover, Kaplan said, backyard units would never be affordable to regular people: “It’s proved that in order to build a unit, you’re going to spend $300,000,” he said. “You’re not going to rent that out for $80 a month.” (Fact checks on all of those claims below.)

The preferred alternative, Alternative 2 in the EIS, shows the actual anticipated development pattern after 10 years under the new rules.

It was refreshing, then, to go to a well-attended public meeting at city hall a few days later—a meeting that Kaplan had told his neighbors would be “basically Madison Avenue coming in and telling you what you should like”—and see that the proponents of the long-delayed proposal outnumbered the naysayers by a factor of about 15 to 1. (Maybe the housing opponents were put off when Kaplan told them it wouldn’t make any difference if they showed up?) Tech workers in their 20s talked about their desire to share the city with people who didn’t have the good fortune to work in industries that pay six-figure starting salaries; homeowners talked about wanting to build backyard apartments so that they could share the city with new neighbors; and environmental advocates talked about density as an important solution to the climate crisis. Several people said they hoped the city would go even further than the preferred alternative and allow three accessory units per property—two inside the main house, and one in the backyard.

But my favorite comment of the night came from Zach Shaner, a renter who lives on Beacon Hill. Shaner (whose name you may recognize because he used to write for Seattle Transit Blog) started off by noting that in the time the city has been working on the EIS, the cost of a median home in Seattle has risen from $591,000 to more than $725,000. “This political process is not morally neutral,” Shaner said. “While we’ve talked and studied and dithered, owning a home has gotten $131,000 harder. In the meantime, my family has given up on owning a home in Seattle.” Shaner and his wife would like to help their friends build an extra unit on their property, he continued, but the current rules make it illegal for them to do so. “I really dream of the day that we have painstaking processes to stop housing rather than to permit it, but in the meantime this is a small but substantive step in the right direction.”

Now for that fact check: In reality, the preferred alternative would increase the number of unrelated people who can live on a lot from the eight allowed under existing rules to 12, and would allow homeowners to build one backyard cottage and retrofit their basement into a living space. The maximum number of buildings on a single lot, in other words, would be two—and any new construction would still be subject to the same rules that limit the amount of lot coverage on single-family land today. The “full build-out” scenario, which Kaplan portrayed as the city’s desired outcome, is clearly captioned, “The Full Build-Out Scenario is included for illustrative purposes only and is not an expected outcome of any alternative analyzed in the EIS.” And it actually looks overbuilt not because of backyard cottages, which are the small red boxes in the image above, but because of all the enormous single-family houses that are technically legal now but have not been built because most homeowners would rather live in charming homes with backyards than cover their lots with eight-bedroom megamansions. The city’s parking study concluded that “each additional ADU would generate between 1 and 1.3 additional vehicles using on-street parking,” not 10. And although higher-cost garage apartments can certainly cost well over $300,000 to build,  many cost substantially less; and it would require a breathtaking ignorance of the current rental market to actually believe that you could rent so much as a bean bag in the corner of an unfinished basement in Seattle for $80 a month.

Morning Crank: The War on Immigrants Is a War on Cities

1. “The war on facts has become a war on cities.” 

That was Mayor Ed Murray’s latest volley in his own war against the Trump Administration, launched yesterday along with a lawsuit charging that Trump has no legal right to pull federal funds from “sanctuary cities” that refuse to enforce federal immigration statutes according to the new Administration’s harsh interpretation of those laws.

Yesterday, the mayor and City Attorney Pete Holmes announced they were filing suit against the US Justice Department, whose director, KKK apologist Jeff Sessions, announced this week that he would pull Department of Justice grants to cities that refuse to assist federal agents in tracking down and detaining undocumented immigrants. Seattle’s 2017 budget assumes $2.6 million in DOJ grants for domestic violence prevention, officer body cams, human trafficking prosecution, and more.

The lawsuit contends that Sessions’ order violates the 10th Amendment, by dictating the way the city enforces federal laws, and the Spending Clause from Article 1 of the Constitution, by attempting to coerce the city into aiding immigration agents by threatening to withhold federal funding if it doesn’t.

“We have the law on our side: the federal government cannot compel our police department to enforce federal immigration law and cannot use our federal dollars to coerce Seattle into turning our backs on our immigrant and refugee communities,” Murray said.

Trump’s war on immigrants is a war on cities because cities are made stronger, politically, culturally, and economically, by the presences of immigrants, and he’s waging that war because city values—diversity, inclusion, resistance, queerness, intellectualism, and unconformity—are anathema to his backward-looking vision of a nation united by fear and mutual distrust. Seattle is the first city to formally resist Sessions’ and Trump’s unconstitutional bullying by filing a lawsuit. If cities’ response to the last unconstitutional order targeting immigrants was any indication, we won’t be the last.

2. A Queen Anne homeowner’s dogged, well-financed effort to kill backyard cottages in Seattle won a victory that will further delay a proposal to make it easier for homeowners to build accessory units and cost taxpayers thousands of dollars in the process.

This week, city council member Mike O’Brien announced that thanks to activist Marty Kaplan‘s successful effort to delay new rules that would loosen the regulations that currently make it prohibitively expensive for many homeowners to build accessory units, the city will do a full environmental impact statement to determine the impact accessory units will have on the city’s environment. The intuitively obvious conclusion would be that backyard cottages improve the environment, because they add density, which helps prevent suburban sprawl and reduce auto dependence. In addition, they allow homeowners to age in place, promoting multigenerational households and preventing the development of lot-line-to-lot-line McMansions that often sprout in neighborhoods when single-family properties change hands.

O’Brien proposed his backyard cottage legislation in May 2016. With any luck, he will be able to introduce new legislation sometime in the summer of 2018.

3. Bikesharing advocates will say goodbye to Pronto with a group ride tomorrow afternoon. Pronto riders will gather at 3rd Ave. and Broad Street at 5pm (there are two Pronto stations within two blocks, but the clunky green bikes are available all over downtown) and ride slowly up Capitol Hill, ending at a bar TBA. “Ed Murray’s house for bell ringing party optional.” Murray announced he was killing the money-losing bikeshare system in January.
