The J is for Judge: Lesser Seattle Has Gaslighted the Pro-Housing Movement

Well, that was like passing a kidney stone. After single-family zone stalwarts spent two years stalling the city’s efforts to allow more mother-in-law and backyard apartments, the city has finally returned with a new proposal to loosen restrictions governing  attached and detached accessory dwelling units.  Three cheers for that.

However, I will say: Unless the proposal—the preferred alternative from the city’s new Final Environmental Impact Statement for accessory dwelling units—is part of a broader series of citywide land use changes that include more actual apartments  in Seattle’s single-family zones, urbanists should not hail this new plan as a pro-city victory. To do so would just confirm how badly housing activists have been gaslit by Lesser Seattle and the convoluted story line that equates building more housing with some sort of George Soros plot.

I’m obviously not as sanguine as Sightline urbanist Dan Bertolet about the city’s latest plan to loosen restrictions on  secondary units in single-family areas. But nor am I as disappointed as the Urbanist, which thinks the changes should do even more to catalyze ADU and DADU development.

Mostly, as someone who has been reporting on this city’s push to increase density for decades now  (and who covered the Queen Anne Community Council’s original challenge to the new rules back in 2016), my reaction is mostly just: “Meh. About time, Seattle.” (Crosscut has an eye-opening timeline on the stalled push for more ADUs and DADUs in Seattle.)

The proposal certainly does some good.  And ironically (as I predicted at the time), the plan is the outcome of an Environmental Impact Statement the city was forced to do after the Lesser Seattleites from Queen Anne won their case to stall these long-overdue land use reforms.  The city’s new proposal increases ADU/DADU development capacity from current standards in place since 2010 by allowing taller and larger detached accessory dwelling units, also known as backyard cottages,  while simultaneously allowing development on smaller lots. The new preferred alternative allows two attached units, providing more flexibility for homeowners who want to build two extra units but may not have the space for a separate backyard apartment. It gets rid of the (pathological) off-street parking requirements for secondary units. It eliminates the requirement for the owner to live on-site if a house has an ADU. It gives one to two additional feet of height for DADUs that have a green design. And—oh no, watch out for laundry on the clotheslines!—it increases the number of unrelated people who can live on one lot from eight to 12.

Merely green-lighting more ADUs and DADUs and declaring victory in the fight to build housing in Seattle’s exclusive single-family neighborhoods is like proposing a congestion pricing scheme that only charges Uber and Lyft and ignores the 25 percent of downtown commuters who drive to work alone.

Perhaps the best change (Sightline’s Bertolet calls it “radical!”)— and one that blows QACC’s cover story that they were trying to prevent small existing houses from being torn down and replaced by huge single-family monstrosities— is that the new preferred alternative shuts down the potential for any McMansion craze. As Erica noted: The proposed new rules limit new houses to just 2,500 square feet or a 50 percent floor-area ratio (FAR), whichever is larger. FAR is the ratio of the square footage of a building to the lot that it’s on.

These are all welcome changes; the original 2009 law that allowed ADUs and DADUs in the first place (itself overdue) underperformed thanks to the rigid guidelines the new proposal unwinds—only 221 were built on the city’s 75,000 eligible single-family lots, or just 37 a year, between 2010 and 2016. Council Member Mike O’Brien’s initial reform proposal (the one the QACC dragged to the hearing examiner in 2016)  was expected to produce about 4,000  accessory units in the next 20 years—about five times the current underwhelming rate.

Burn on the QACC: The new-and-improved proposal doubles that, to an estimated 4,430 new units in the next 10 years.

Still, the proposal doesn’t solve the underlying problem: Seattle’s ongoing housing shortage, which is exacerbated by the fact that 65 percent of the city’s developable land is exclusively reserved for single family zones. Merely green-lighting more ADUs and DADUs and declaring victory in the fight to build housing in Seattle’s exclusive single-family neighborhoods is like proposing a congestion pricing scheme that only charges Uber and Lyft and ignores the 25 percent of downtown commuters who drive to work alone.

In the absence of more meaningful changes to the city’s exclusionary zoning laws, simply allowing more ADUs and DADUs is not a win—it’s a capitulation to anti-density activists who have moved the goalposts by keeping most of the city off-limits to any development, making even incremental victories like this one seem more significant than they are. Building 4,000 units over the next ten years falls far short, for example, of the 14,000 affordable units Seattle needs to simply address the existing homelessness crisis.

The ADU/DADU proposal must be coupled with other land use reforms that dismantle the wall around single family zones. The city’s actually “radical” 2015 proposal to allow multi-family development in single-family areas (which it  dropped after the Seattle Times stoked a privileged neighborhood tantrum of Lindsey Graham proportions)  has since been whittled down to allowing some multifamily housing in just six percent of the areas that are currently zoned single-family—and only along the edges. Hopefully the city will eventually enact this mild reform as well. (Another Lesser Seattle neighborhood group is now challenging this scaled-back proposal in front of the hearing examiner, naturally).

Until the city allows more housing of all types in walled-off single-family zones, slightly more permissive rules for secondary units will represent a limit, rather than a license to increase housing stock.

So Much for Compromise: Amazon-Backed Business Coalition Invests Big to Kill Head Tax

Remember when, just a couple of weeks ago, Amazon held the whole city hostage by halting plans to build one 17-story tower and threatening to sublease space it had planned to rent in another? The issue was the size of the proposed head tax to fund housing and services for some of the thousands of people living homeless in Seattle: A majority of the city council wanted the tax to be $500 per employee on every business with gross revenues of more than $20 million a year (Amazon plus nearly 600 other companies); Amazon said it couldn’t go a cent higher than $250. Over a weekend of frenzied negotiations, in which Mayor Jenny Durkan reportedly served as the conduit between Amazon and the city council, that five-member majority evaporated, and on Monday, the council voted unanimously to approve the $275 tax that Amazon supposedly wanted. Amazon resumed construction, everybody breathed a sigh of relief, and the council prepared for the next battle—a debate over how to spend the money, about $47 million a year, that the hard-won head tax would generate.

Fast forward a couple of weeks, and it looks like Durkan—and the council—were in over their heads. Amazon may still be building in Seattle, but they have one foot out the door, and last week, they made their first pledge—$25,000—to the “No Tax On Jobs” referendum campaign. The campaign enjoys the backing of not just other corporate behemoths (Kroger, Starbucks, Centurylink) but a who’s who of local developers, hotel industry players, and maritime and industrial businesses. So far, the anti-tax campaign has brought in more than $352,000 in financial pledges—and that doesn’t count the free labor the companies’ anti-tax messaging has received from regular citizens who are mad at the city’s response to homelessness, who are cheerfully gathering signatures at farmers’ markets and community meetings around the city. (The dubious connection between a tax on the largest corporations and ordinary taxpayers is that if companies like Amazon are required to pay additional taxes, they will leave the city, taking all those high-paying jobs with them. The irony that many of the people who are freaked out by this scenario are the same people who stridently oppose the increased traffic and population density that all those “jobs” produce appears to be lost on many head tax proponents.)

It’s hardly surprising that Amazon is looking out for its bottom line. What is a bit surprising is that Durkan seems to have believed that her half-measure “compromise,” which was focused on Amazon and not the rest of Seattle’s politically active business community, would quell a rebellion. When former mayor Ed Murray (who resigned in disgrace after allegations that he sexually abused minors decades ago) wanted to make sure that the $15 minimum wage proposal would stick, he created an unprecedented business- and labor-led advisory committee that included representatives from the Seattle Hospitality Association, the Chamber of Commerce, and local businesses like Ivar’s and Nucor Steel along with labor and social-justice groups. Over five months, that group hammered out a deal that phased the $15 minimum wage in slowly, over seven years, with extra concessions for the small businesses that would be most impacted by the increase. By next year, workers at all but the smallest businesses in Seattle will be making a minimum of $15 an hour.

Four years ago, Seattle Hospitality Group founder Howard Wright stood beside the mayor for a photo op as he signed the legislation making $15 the law of the land. This week, he donated $25,000 to the effort to kill the head tax.

Maybe compromise is harder than it looks.

Morning Crank: The “Unique Problem” That Separates Us from Salt Lake City and Houston

1. A line of people and pets snaked along the eastern perimeter of CenturyLink Field yesterday morning as the United Way’s annual Community Resource Exchange, an annual event where volunteers and service providers offer resources, food, dental care, and other services to people experiencing homelessness. Upstairs, in the stadium’s event center, a decidedly more well-heeled crowd gathered for an event called the Changemakers Rally—a series of short speeches, actually, followed by a panel discussion with leaders from Amazon, Starbucks, and Zillow, along with All Home, the Chief Seattle Club, and United Way. The highlight of the odd event wasn’t the anodyne address by Mayor Jenny Durkan, who skirted substance in her speech and during the brief Q&A with remarks like, “We need to commit over time to make this change in people’s lives for every day of their lives” and “We know what works, we just need to do it and have the collective will to do it.” Nor was it an awkward onstage back-and-forth between United Way board chair Kathy Surace-Smith and Justin Butler, a formerly homeless Metropolitan Improvement District Ambassador who moved here from Phoenix and couldn’t be prodded to say much more about the Community Resource Exchange beyond, “Well, it got me a job.”

No, the highlight was when Starbucks VP John Kelly took the mic and used his time to blast the Seattle City Council for considering an employee hours tax to fund investments in homelessness at a cost of up to $75 million a year, a proposal he called an example of the way “our government keeps on targeting [businesses] as a  source of funds rather than innovators and problem solvers.” Starbucks has focused its homelessness spending on family homelessness, as has Ohio homelessness consultant Barb Poppe, whose famous/infamous “Poppe Report” is the blueprint for Seattle’s Pathways Home initiative. Kelly highlighted that report, which calls on the city to move funding away from service-rich transitional housing toward “rapid rehousing” with short-term vouchers to help people rent apartments on the private market. “We know the decisions, we’ve got the Poppe Report with all the solutions, the blueprint is there—we just need to act on reform,” Kelly said. “Barbara Poppe has worked with Salt Lake City and Houston and seen demonstrable progress.”

The “unique problem” that differentiates  Seattle from those two cities, Kelly continued, is that only Seattle has a large number of families living on the streets and in cars. The other difference, of course, is that Seattle apartments cost about twice as much as apartments in either of those cities, thanks in no small part to a housing shortage that is also unlike anything Houston or Salt Lake City is experiencing.

2. A curious addendum to the saga of former mayor Ed Murray, who resigned last year amid accusations that he had sexually abused several minors in the past: Last April, as the scandal was breaking, Murray filed a financial disclosure report showing that he owned just one property—his Seattle house on Capitol Hill, valued at $876,000. (I came across Murray’s financial documents while I was looking into an item related to current Mayor Jenny Durkan’s own investments). That was odd, because a previous financial disclosure report, from 2016, showed that he owned another house—a three-bedroom, two-bath vacation home in the coastal community of Seabrook, which Murray and his husband Michael Shiosaki bought in November 2015 for $470,000.

Murray amended the report to include his second home six weeks after filing the initial report without it. However, those six weeks—from April 14, when he filed the initial report, to May 31, when he corrected it—were critical ones. During April and May, while the press was all over the story, Murray repeatedly pleaded poverty—claiming, for example, that he needed a special dispensation from the Seattle Ethics and Elections Commission allowing him to raise money from supporters for his own legal defense because as “a lifelong public servant, [he] does not have the personal resources needed to fund his own legal defense.” Murray also told Q13 Fox that he had “no assets.” Referring to his house in Seattle, he said,  “Michael owns the house.” In fact, both Shiosaki and Murray, who are married, are listed as the owners of both houses.

The mis-filed report could have been a simple oversight, and the addition of the house didn’t change Murray’s total assets, which he listed in 2017 as $1.8 million. Murray and Shiosaki still own the Seabrook house, which can be rented for between $148 and $335, depending on the season. One other bit of historical trivia: In 2013, when he was still a state senator, Murray earmarked $437,000 in the state budget for a new bike and pedestrian connection between Pacific Beach and Seabrook—at the time a brand-new planned community—at the request of a longtime friend who owned a house there. Not long afterward, the friend maxed out to Murray’s first campaign. And about two years after that, Murray himself bought a vacation house in the town.

3. After the Seattle Times reported last week that, according to King County Metro, the downtown Seattle streetcar will cost 50 percent more to operate than the Seattle Department of Transportation previously claimed, Mayor Durkan requested an independent review of the $177 million megaproject, which is already under construction. On Tuesday, city budget director Ben Noble told the council’s transportation committee that the mayor’s office is concerned about “whether we have accurate information about the operating costs and… potentially the capital costs as well.” That prompted council member Lisa Herbold, a longtime opponent of the streetcar, to suggest “pressing pause” on the project until the city could get a handle on how much it will cost to operate and build (and how the city will pay for any overruns). Goran Sparrman, SDOT’s interim director, suggested that putting the project on ice, even temporarily, could put federal funds at risk and lead to higher costs in the future, since the cost of labor and materials tends to escalate while projects are idle.

Fans of the downtown streetcar, which will link the South Lake Union and First Hill streetcars, will conclude from today’s discussion that it makes sense to keep plowing ahead with the project; even if the thing is over budget, the costs will only get worse if we wait. Detractors, meanwhile, will see that argument as an example of the sunk-cost fallacy—the idea that because the city has already invested so much in the project, the only option is to keep building, when in fact, there’s something to be said for quitting while you’re ahead.

How Mayor Durkan Could Surprise Seattle

When Jenny Durkan and Cary Moon emerged as the top two vote-getters in the August primary election, there was no longer any question that Seattle would elect a female mayor. But when Durkan emerged victorious, with a commanding 56 percent of the vote, many were wondering if the first woman mayor in nearly 100 years would merely be more of the same. (Bertha Knight Landes, the first female mayor of a major American city, ended her single two-year term in 1928, when she was beaten by a man whose primary platform plank was that he was not a woman. No woman has come close to being elected mayor of Seattle since.)

“Murray 2.0” was a tag that dogged Durkan throughout the campaign, and the new mayor has been pilloried by Seattle’s left, with some justification, for being the “establishment” candidate—the one with money, backing from big businesses like Amazon and Comcast, and insider connections (her sister Ryan is a land-use attorney with many major local clients, her brother Jamie was a prominent Seattle lobbyist, and her brother Tim works for the city.)

Durkan has flinched at the “establishment” label—pointing to her work as an early advocate for marriage equality (Durkan is gay) as well as her support for undocumented immigrants as US attorney under former President Obama—but will it stick? She has four years to answer that question; in the meantime, here are some ways we think Durkan could—not will, but could—surprise Seattle:

By actually sticking to her promise to be the mayor “of the people, not of City Hall.”

On her first day as mayor, Durkan attended ceremonial swearing-in ceremonies from Delridge to Phinney, Ridgeand was officially sworn in several miles south of city hall, at the Ethiopian Community Center in Rainier Beach. If she keeps her commitment to be out in the neighborhoods, listening to neighborhood concerns personally instead of sending emissaries to meetings that are likely to get hot (as her predecessor Murray often did), she will build valuable trust, especially in communities that feel they lack a voice at city hall, like the East African immigrants of South Seattle or renters getting priced out of neighborhoods across the city.

Durkan may have appointed Murray’s former chief of staff, Mike Fong, as her senior deputy mayor, but don’t let that fool you: Fong’s experience as a policy wonk and City Hall dealmaker long predates his time in the Murray office, spanning all the way back to 2001, when he worked as a policy staffer for the city council. Her other deputy mayor, Shefali Ranganathan, led the pro-transit Transportation Choices Coalition. The mayor has the ability to hire and fire the heads of more than two dozen city departments. This week, she announced the (voluntary) departure of police chief Kathleen O’Toole and the (requested) departure of City Light director Larry Weis. Scott Kubly, the head of the Department of Transportation, is already looking for jobs elsewhere. (Jesus Aguirre, the parks director, left shortly before Durkan took office.)

By implementing an activist agenda that includes compromise versions of policies Seattle’s left holds dear.

Some of her detractors scoffed when Durkan made free community college tuition a centerpiece of her campaign—her opponent Moon, for example, who immediately issued a statement calling for a progressive statewide income tax and capital gains tax to pay for education instead. Less than a week into her term, Durkan has already signed an executive order directing the city to come up with a plan to pay for the two-year-college proposal, and to begin implementing it in 2018, by expanding the number of credits that people in an existing program called 13th Year Promise can take for free. Other areas where Durkan could move fast: Implementing a new business tax or taxes on large employers—a proposal that came up late in this year’s budget cycle and failed to pass; expanding the families and education levy, which is up for another vote next year, to increase access to preschool; and moving forward with a safe drug consumption site in Seattle, which Durkan identified as a priority on the campaign trail.

By not being the new Ed Murray—and being the new Greg Nickels instead.

Below the marquee positions, Durkan’s day-one staff looks like the who’s who of the Nickels years, which ran from 2001 to 2009. There’s major initiatives director Kylie Rolf, Nickels’ onetime outreach coordinator; Andres Mantilla, also on Nickels’ outreach team; legislative affairs director Anthony Auriemma, who worked for Nickels late in his term; and office administrator Lyle Canceko, a former communications staffer for Nickels. Will surrounding herself with staffers for the former mayor, a competent centrist who was ousted after his muddled handling of a major snowstorm, make Durkan more likely to govern like Nickels, too? Hard to say—but during her kickoff in Rainier Beach, she did work in one snowstorm joke.

And finally: By surprising some of the transit advocates and urbanists who didn’t support her and being an effective advocate on the Sound Transit board.

No, Durkan isn’t likely to revisit the Housing Affordability and Livability Agenda—an Ed Murray initiative that irks many urbanists because it doesn’t increase density at all in single-family neighborhoods, which make up the vast majority of Seattle’s residential land. But during the campaign, when her opponent was promising to speed up light rail with a loan that Sound Transit said wouldn’t actually help them, Durkan offered her own plan to get the trains running to Ballard and West Seattle faster by expediting the permit and construction process and paying for better bus service in the meantime.

 

Morning Crank: Mayor Gonzalez?

1. City council president Bruce Harrell took the oath of office as Seattle’s emergency mayor yesterday (OK, real mayor, but only for another two and a half months max), promising to announce by today whether he will continue to serve as mayor until voters elect a successor to former mayor Ed Murray, who resigned this week after a fifth man accused him of sexual assault. .

The stakes for Harrell are high, although perhaps not as high as you might think: Although serving as mayor until the election results are certified at the end of November would require Harrell to give up his council seat, rumors have swirled since his most recent election in 2015 that this term, Harrell’s third, would be his last. Harrell ran for mayor and lost in the primary in 2013, so remaining as mayor would give Harrell a short-lived opportunity to serve in the position he lost to Murray four years ago.

If Harrell does stay on as mayor, Lorena Gonzalez would be next in the (informal) line of succession for council president. If he decides to return to the council, the council would choose another council member to serve as mayor. While Tim Burgess is an obvious choice—he’s stepping down this year, to be replaced in January by either Jon Grant or Teresa Mosqueda—the fact that Burgess chairs the council’s budget committee inserts a political wrinkle into the decision. If Burgess becomes mayor, the chairmanship of the budget committee would pass to council freshman Lisa Herbold—a member of the council’s left flank who might be more inclined than the centrist Burgess to tinker with Murray’s budget to reflect more left-leaning priorities (like, say, reducing the emphasis on rapid rehousing in the Human Services Department’s budget).

So who does that leave? Gonzalez, who was the first council member to call on Murray to resign, appears to be the next in line. She’s running for reelection this year, and assuming she wins, would be able to go right back to being a council member when the results are certified in November

Harrell has said he will make his decision before 5:00 this afternoon.

2. The Seattle Ethics and Elections Commission dismissed a complaint by one of the losing candidates in the August primary election against Seattle City Council Position 9 incumbent Lorena Gonzalez. That complaint alleged that Gonzalez had deliberately misled the commission about how many open debates she had participated in before the primary and demanded that the commission fine her and force her to  return all the money she has received from voters in the form of “democracy vouchers.”

“If the Commission terminates the candidate’s participation in the Program, it will invalidate the choice of the more than 2,100 residents to date who have assigned their vouchers to Councilmember González,” commission director Wayne Barnett wrote in his recommendation to the commission. “The Program exists to empower residents to participate in elections in ways they have not been involved in the past. The Commission should be cautious about exercising the ‘nuclear option’ in a way that disserves one of the primary goals of the Program.”

Although the commission ruled against Gonzalez’ erstwhile opponent, Barnett’s recommendation letter raises interesting questions about the breadth of the initiative that instituted public financing of local elections, and could have implications for what campaign forums look like in the future.

The democracy voucher program requires any council candidate seeking voucher funding to participate in at least three forums at each stage of the election (primary and general) to which all candidates have been invited to participate. The complaint argued that because the losing candidate was not invited to some of the forums Gonzalez listed as qualifying events (including a “women of color” forum), she should have to return all her vouchers. This interpretation could require candidates to figure out who was invited to every potentially qualifying event they attend. Or it could mean that every single candidate must be invited to every debate, regardless of whether they are viable. In the mayor’s race, Barnett points out, that would have meant that every debate could have included all 21 people who filed for the position, including “Nazi shitheads” screamer Alex Tsimerman—a prospect that would have rendered the debates more or less useless for people hoping to learn anything about any of the six candidates who were actually viable.

3. Some people just can’t take a joke. And some people just can’t get a joke—even when you explain it to them. Case in point: Last week, I ran an item about a going-away gift from the mayor’s staff to longtime City Hall staffer (and Murray chief of staff) Mike Fong—a giant fake check for $3.5 million made out to the “Michael Fong Community Health Engagement Location.” (CHEL is bureaucratic code for supervised drug consumption sites.) As I wrote at the time, “The joke, concocted by Murray’s comms director Benton Strong, is a little obscure.”

Too obscure, apparently, for Neighborhood Safety Alliance member Jennifer Aspelund, who filed a records request on Friday, September 8 seeking “any monies allocated for Michael Fong community health engagement location center and any discussion of such center.”

The city’s response? “This location center does not exist; therefore, the Mayor’s office or any other departments do not have any responsive records.”

The C Is for Crank Interviews: Lorena Gonzalez

Incumbent city council member Lorena Gonzalez may have only been on the council for two years, but she has already made her mark as head of the council’s public safety and gender equity committee, which has spent the past five years, give or take, overseeing the implementation of police reforms in the city. (In 2012, the US Department of Justice ordered the Seattle Police Department to implement reforms to curb excessive force and racially biased policing, and a US district judge has refused to release the city from the consent decree until he is satisfied that the city is in compliance). Gonzalez, a civil rights attorney who was Mayor Ed Murray’s chief counsel before running for council in 2015, was the first council member to call on Murray to resign after the Seattle Times reported on records related to the sex-abuse case against him in Oregon, where a child-welfare investigator concluded that Murray had sexually abused his foster son in 1984.

I sat down with Gonzalez late last month at Uptown Espresso in West Seattle.

The C Is For Crank [ECB]: You were first council member to call for Murray to step down. How do you feel about that decision now?

LG: I feel as strongly today as I did then about needing to take a very strong moral position that the mayor should step down. It was hard for me to realize that I would be standing alone on that for quite some time, and I’m okay with that, because it was the right thing to do. I will always choose the side of survivors, and so if I could go back, I would do it all again.

ECB: I assume it’s damaged your relationship with the 7th floor.

LG: (Laughs.) I think I have had the great benefit of having really strong relationships with a lot of the mayor’s staff because they’re former coworkers and colleagues of mine, and I continue to work collaboratively with a lot of my former colleagues on the 7th floor to get done what we need to finish getting done. That being said, the mayor and I have not personally communicated since my announcement.

ECB: That must be hard, since you worked with him so closely in the past.

LG: This whole thing is hard because of that. He’s somebody that I respected. He’s somebody that I trusted. He’s somebody who motivated me enough to leave a ten-year-long career doing civil rights work and sexual survivor advocacy work that I really fundamentally believed in and loved. And personally, it was difficult for me to process and accept that the what I saw in the investigation file from Oregon was true. So that was very personally difficult to reconcile all that.

ECB: The city has made progress on police reform, but there are still gaps and calls for reform. What additional efforts would you like to see on police accountability and reform?

LG: I actually think we have made significant strides, but that doesn’t mean that we are close to being there yet, whatever ‘there’ is. The reality is that the [police accountability] ordinance that I sponsored, that was approved by unanimously by the council in May of 2017, hasn’t been implemented yet. And it hasn’t been implemented yet because we haven’t been able to convince the federal court to allow us to move forward with the ordinance, and part of that is because [federal district judge James Robart] has legitimate concerns around the powers that our police union holds in the collective bargaining process. And until we are able to convince the judge that we are willing to prioritize constitutional policing above all else, even in the collective bargaining process, then we will continue to be in  a place where this ordinance is in limbo and where some of the huge significant policy changes that are reflected in the ordinance won’t be implemented until we convince the judge that we’re willing to hold the line.

“I feel as strongly today as I did then about needing to take a very strong moral position that the mayor should step down. It was hard for me to realize that I would be standing alone on that for quite some time, and I’m okay with that, because it was the right thing to do. I will always choose the side of survivors, and so if I could go back, I would do it all again.”

ECB: Some reform proponents have suggested that police union negotiations be held in public. Why do you oppose that idea?

LG: I think that that’s a fundamentally anti-labor position. The reality is that the state really does dictate what the rules are around collective bargaining, and we as a city are beholden to those rules. I think what we have historically seen in the city of Seattle is that our agreed-upon system of accountability and discipline has historically been eroded in the collective bargaining process. So I think for me, what is more important is how do we engage in collective bargaining with unions where we make sure that there is no backsliding on the intent and purpose that we’re trying to accomplish through our legislation.

Something that I think could be incredibly powerful in that context, that has been suggested by people like retired judge Anne Levinson, is the idea of having a special monitor in the labor negotiation processes that would just be focused on tracking whether or not the proposed parameters or a final tentative labor agreement have caused some backsliding on what the actual intent and purpose is, as reflected in the police accountability legislation.  I think that level of technical assistance provides more real information about whether or not there’s backsliding than just allowing sort of people who might not understand the intricacies of these policies to speculate as to whether or not they’re working.

ECB: Would part of the aim of creating a monitor position be to satisfy the objections of people who want to give the CPC more authority over things like hiring and firing the police chief and instigating investigations?

LG: I think we’ve empowered the Community Police Commission to the extent that they want to be empowered.  The CPC did not ask for a system that doesn’t look like what it looks like now. They asked to have the role that they currently have in this version of the ordinance. They did not ask for the power to fire the chief. They did not ask for the ability to discipline or do individual investigations. And they fundamentally wanted to stay focused on, how can we create a table of community leaders and members who would have the power and ability to do systemic review and make fundamental recommendations to change those systems if the system becomes unhealthy. And that’s what they decided as a democratic body to advocate for in this legislation, and that’s what’s reflected in the legislation.

ECB: Given that we’ll have a new mayor next year,  I wondered if there’s any part of HALA that you would want to revisit once Murray is out of office.

LG: I’d like to spend more time thinking about displacement tools. A lot of times, people think the mandatory housing affordability program is an anti-displacement tool, but in reality, it really is designed to increase the stock of affordable housing for people of a certain income. It’s not the very low or extremely low-income folks. And so I do think there’s an opportunity for city council to really step into the anti-displacement arena.

I continue to be really interested in having the conversations around opening up more of our single-family zones to multifamily housing. And it’s obviously a very delicate conversation to have, and it’s delicate for a variety of reasons. But just because it’s a tough conversation doesn’t mean that we shouldn’t have it. And we should explore best practices in terms of how we can best engage the community and how we can pilot at least a version of what I think there is interest in doing.

ECB: Given how controversial the mandatory housing affordability (MHA) program was at first, it’s been interesting to watch the council pass every upzone unanimously.

LG: But it’s because it’s in urban villages.

ECB: Right—the problem is that we have single-family zones where you can’t even build a duplex. Were you disappointed when Murray pulled back on opening up single-family zones to more types of development so quickly?

LG: I think it’s fair to say that I wish we could have had more of an opportunity to really see how the conversation could have unfolded. These conversations are really tough, right, because we’re talking about fundamentally changing parts  of the city that have never had to change, so I think we could have potentially benefited from allowing the city and its residents more time to have that public conversation.

ECB: How do you think the mayor’s navigation teams have been performing, in terms of getting people in tents into safer shelter as well as into permanent housing?

LG: I think it’s better than what we had before. I will say that I share concerns about having the Office for Civil Rights being effectively the auditor of how that outreach is occurring around the encampment conversation as a whole, which is where these navigation teams are being used primarily. The Office for Civil Rights has an inherent conflict because they are a department of the executive and it’s a very small office, and I just don’t know how a small office like that could reconcile that conflict of interest and be a true independent auditor.

ECB: How would you resolve that conflict?

LG: I think that the Office for Civil Rights should be its own independent office that has stand-alone authority, similar to the Seattle Ethics and Elections Commission and hopefully someday soon similar to the Community Police Commission, or to shift that work to the city auditor’s office. I’m not sure that there is any other way to ensure that that work isn’t being unduly influenced by the political will of the executive.

ECB: Mike O’Brien has proposed creating a new program where people living in cars and RVs could get immunity from tickets in exchange for accepting services. Is that approach something you’ll support?

LG: Council member O’Brien’s approach is one that makes some sense to me in terms of requiring people to sign up to be part of this registration program. And that would allow outreach workers to know exactly where you’re at, and it also requires you as a person who’s camping to commit to be engaged in service efforts. So I think that that component of give and take is an important one, and it imposes a responsibility on campers that doesn’t currently exist.

I think that impounding somebody’s vehicle as a result of unpaid fines and tickets is not helping our homelessness situation. That, to me, is not a harm reduction approach to the situation. The only thing that we gain by continuing to tack on legal fees that lead to an impoundment is moving people from camping in cars to camping outside and I don’t think that that’s what any of us want. I think the big, tough question will be, how do we administer it? How do we fund this program? And at this point we don’t know what the funding would be. And is that how we should be using our funds in the context of also shifting towards upping our investments in permanent supportive housing?

 

ECB: When the Poppe Report on homelessness came out and the city started moving away from transitional housing in favor of a rapid rehousing approach, you expressed concern that domestic violence victims and others who currently use transitional housing might be shut out in the new housing-voucher-based system. Do you still have those concerns?

LG: I will continue to track that particular issue. I had heard from the Human Services Department that that is a question of prioritization of the funds and have been assured that those individuals—families and survivors—are at the top of the priority list, as some of the most vulnerable populations within a vulnerable population.

ECB: How did you feel when the Seattle Times endorsed your opponent, Pat Murakami?

LG: Oh gosh—it was really disappointing to me, and on a professional level, it felt more like a referendum on the entire  city council, on the work that we have been doing over the last two years. And I accept the fact that I am the only incumbent running for reelection in the city government besides the city attorney, but it really just felt like there was an unloading of sorts that needed to happen, and I was going to be the person who was going got be on the receiving end of that. I think it’s unfortunate, because I do believe that the city is moving in the right direction, and I think that that is in part because of the leadership that the city council has provide over the last two years. I think that, at the end of the day, my primary election results show that people are still happy with the work that I’m doing on the city council and with the direction of the city.
