Founded in January 2009, PubliCola is a blog about Seattle written by journalists who are dedicated to non-partisan, original daily reporting that prioritizes a balanced approach to news. Started by longtime local editor and award-winning reporter Josh Feit, PubliCola is the first online-only news site in state history to get media credentials to cover the state capitol.

PubliCola was off and running. In June 2009, PubliCola hired another award-winning journalist, super-sourced Seattle city hall reporter Erica C. Barnett.

Bringing you cola for the people, PubliCola is named after Publius Valerius PubliCola, the alias for the authors of the Federalist Papers—the original bloggers.

The first online-only news site in state history to get media credentials to cover the state capitol and Seattle city hall, PubliCola has been called a “must-read” by the Seattle Post Intelligencer and a hot “New Media Mover and Shaker” by Seattle Magazine—which also cited our own Erica C. Barnett as the city's No. 1 news nerd.

Is Rob McKenna Going Rogue?

As we reported on Monday, Attorney General Rob McKenna announced today that he was “joining a multi-state lawsuit challenging the constitutionality of the recently-approved federal health care measure, once it is signed into law.”  McKenna goes on to state:

“I believe this new federal health care measure unconstitutionally imposes new requirements on our state and on its citizens. This unprecedented federal mandate, requiring all Washingtonians to purchase health insurance, violates the Commerce Clause and the 10th amendment of the US Constitution.

“I’m concerned that the measure unconstitutionally requires all Washingtonians to purchase health insurance and places an extraordinary burden on our state budget by requiring Washington to expand its Medicaid eligibility standards in violation of our state’s rights guaranteed under the10th amendment.”

McKenna is not acting at the request of the Governor or the State legislature or any State Officer.  By his own press release he is acting on his own beliefs and concerns.  But is he authorized to institute litigation on behalf of the State based on his own beliefs and concerns?

Article III, Sec. 21 of the Washington Constitution provides: “The attorney general shall be the legal adviser of the state officers, and shall perform such other duties as may be prescribed by law.”  Thus, the Constitution itself provides no authority for McKenna to bring his health care challenge.

RCW 43.10.030, which proscribes the general powers and duties of the attorney general has only two potentially relevant provisions:

(2) Institute and prosecute all actions and proceedings for, or for the use of the state, which may be necessary in the execution of the duties of any state officer; . . .

(8) Enforce the proper application of funds appropriated for the public institutions of the state, and prosecute corporations for failure or refusal to make the reports required by law . . . .

Neither of these provisions seems to grant the power to the Attorney General to challenge the constitutionality of a federal law on his own volition.  There is almost no case law in Washington interpreting the Constitutional or Statutory power of the attorney general as to the exercise of his powers other than to observe that the attorney general has the discretion within his constitutional and statutory authority whether to initiate or defend an action.  So case law is of little help as a source of McKenna to proceed. So attorney general McKenna what gives you the power to bring and expend the state’s resources on such a lawsuit?  Washington’s citizens deserve to know.

    We should thank him for showing us his true colors, he had us fooled that he was a moderate when he ran for AG. No more. I hope this costs him his grandiose political ambitions.

    As the chief legal officer for the state, the attorney general typically represents state officials or agencies. However, he is a statewide elected official who, under state law, can bring lawsuits on behalf of the citizens of the state

    I have a much different definition of hero. Rescuers at 9/11. The men and women in our Armed Forces. FDR and Truman, men who actually won a World War.

    Those men are actual heroes, people who fight for what's right in this country. Your use of that word to describe McKenna's entirely self-serving action cheapens the word. For shame.

    Unfortunately, this will bolster his standing with the Washingtonians who aren't liberal, who may be at least 50% of the state.

    On a practical level, RCW 43.10.030(2) more or less covers what he is doing. It's vague, but I'm pretty sure it covers it.

    Why he's joining the lawsuit is beyond me. I can't see the political advantage (is there a viable Republican on the right that he needs to fend off that I'm unaware of?), and while the Democrats aren't as popular right now as we were two years ago, by 2012, I fully expect to see improvements to the economy, and some of the benefits of this bill…I'm sorry, of this law…will have kicked in, and these are some of the good ones (and not the mandate).

    At least it has given some good fodder for Democrats to pounce on. This may make him seem like a “hero” to morons and folks in Eastern WA, but it will serve as one more reason for the Democratic base to really fight for a Jay Inslee (or whoever is our nominee) win in November 2012.

    Right now this is all McKenna has to start his campaign. He could expand into immigration later, as that seems to be the next federal fight. He's not fighting against health care, he's fighting for “freedom”, as matthewwrennwhatever says. Dems should by now know the danger of counting Republican candidates out just because they do things we think are stupid.

    Next you'll be telling us that the bombshell/rumor that Dan Savage has let loose that McKenna is transgendered isn't admissible to discussion. Which, in properly honorable society is probably isn't, but this is politics, and there almost nothing isn't fair game.

    I receive, in my email, several fundraising requests per day from various progressive organizations. They say things like, “Please donate now to …” They are often on behalf of a candidate that is supported by the progressive organization.

    McKenna will be the beneficiary of such national fundraising emails by right leaning organizations as a result of his actions as WA AG. This will bring him some of the money that he will need to run an effective campaign for Governor (or Senator) in what is, essentially, a blue state.

    Q: Why is he doing this?

    A: Politics.

    I am totally with Sarah68 on this. It would be very unwise for progressives to underestimate Rob McKenna.

    “Dragging Israel into this”?! “This” has little to do with Israel; it has to do with McKenna's political actions. Go back and read Ramsey's linked article. Signing a letter as Washington AG on the Gaza situation puts McKenna's judgment and perspective at issue and is fair game. McKenna's signing WA state on to a tea-bagger driven attempt to unravel the first significant in the health care system in this country since Medicare is similar.

    Either this is a political stunt, or McKenna is a legal nitwit.
    As identified, McKenna is on thin ice for assuming he has the authority to proceed, but the better question is why he has failed to provide the specifics of the HCR law or the precedent to justify his concern</> of unconstitutional requirements. He first voiced this concern</> and his intention some time ago. Furthermore, it is not unconstitutional for the federal government to impose a burden, large or small, upon states. McKenna's statement in this regard is just utter nonsense.

    Well, yes, I will. What on earth does McKenna's gender have to do with this? I'll admit that his signing a letter on Gaza is not appropriate to what he's actually elected to do, but his gender status really isn't in any way our business, since it has nothing to do with what he DOES.
